The Contractor, acting as an independent contractor, shall do everything required by the Contract Documents and shall timely complete the project in strict compliance with all requirements and specifications set forth in the Contract Documents. Contractor represents and warrants that he has special skills which qualify him to perform the Work in accordance with the Contract and that he is free to perform all such Work and is not a party to any other agreement, written or oral, the performance of which would prevent or interfere with the performance, in whole or in part, of the Work. All work shall be performed in compliance with all applicable federal, state, and City laws and regulations, including but not limited to all grading and construction ordinances of the City The Scope of Work includes placement of drainage pipes, and other incidental items to address storm water runoff. Not less than the prevailing hourly rate of wages shall be paid to all workmen performing under this contract in this area according to the rates determined by the Department of Labor and Industrial Relations of the State of Missouri. The City of Town and Country is a tax exempt entity. A project exemption certificate will be supplied to the successful contractor. The City of Town and Country shall award any contract based on the proposal that, in its sole discretion, best meets the interests and requirements of the City. The City of Town and Country reserves the right in its sole discretion to reject any and all proposals, to waive technicalities or deficiencies in any or all the proposals, to negotiate with any or all bidders or others for other or more favorable terms or prices, and/or to award the contract to other than the bidder submitting the lowest cost proposal, with or without negotiation.
