NYS Labor law requires that all contracted employees performing maintenance, repairs or capital improvements in state owned buildings receive the prevailing wage and supplements rate for the occupation in which they are working. Certified payroll record/s MUST be submitted at the time of invoicing. Effective April 28, 2008, if this is a public work contract covered by Article 8 of the Labor Law, the contractor understands and agrees that the filing of payrolls in a manner consistent with Subdivision 3-a of Section 220 of the Labor Law shall be a condition precedent to payment by the State of any State approved sums due and owing for work done upon the project. Without submittal of certified payroll record/s, payment will not be made.
