This Contract provides for the improvement of approximately 0.48 miles of NE 7th Avenue within the City of Oak Harbour. The work includes, but is not limited to planing existing surfaces, placing HMA, utility structure adjustments, installing water mainline, storm drain line, sidewalk, shared use path, permanent roadway signage, roadway striping, structural earth wall, traffic control, and other work, all in conformance with the Contract The City of Oak Harbour reserves the right to reject any or all bids, to waive irregularities or informalities in the bid or in the bidding, to accept any alternate bids, and to make such award that it deems to be in its best interest and pursuant to the terms of the General Conditions. The City of Oak Harbor intends to award a contract to the lowest responsible and responsive bidder. Each bid must be accompanied by a cashier's check, money order or surety bid bond in the amount of not less than five percent (5%) of the total bid, made payable to the City of Oak Harbour. A Performance Bond as well as a Labour and Material Payment Bond will be required with the Contract. The City of Oak Harbour reserves the right to postpone the award for a period of 60 calendar days after bid opening. All laborers and mechanics employed or working upon the site of the work (or otherwise working in construction or development of the project under a development statute), will be paid unconditionally and not less often than once a week, and without subsequent deduction or rebate on any account (except such payroll deductions as are permitted by regulations issued by the Secretary of Labor under the Copeland Act (29 CFR part 3)), the full amount of basic hourly wages and bona fide fringe benefits (or cash equivalents thereof) due at time of payment computed at rates not less than those contained in the wage determination of the Secretary of Labor which is attached hereto and made a par hereof, regardless of any contractual relationship which may be alleged to exist between the contractor and such laborers and mechanics.
