HVAC upgrades at Allen Roberts Elementary School, Salt Brook Elementary School, and New Providence Middle/High School. 1. Proposal Form and Proposal Form Affidavit The required Form of Proposal and Affidavit are provided in this Project Manual. Failure to submit this completed Form will result in the disqualification of the bid. 2. Certified Check or Form of Bid Bond or Bid Guarantee Guarantee payable to the Board of Education that the bidder, if the contract is awarded to him, will enter into a contract thereof. Guarantee shall be in the amount of 10% of the bid, but not in excess of $20,000 and may be in the form of certified check, cashier's check, or bid bond. 3. Consent of Surety Certificate from a surety company as per N.J.S.A. 18A:18A-25, stating that it will provide the bidder with a bond in such sum and form as required in the Specifications. 4. Bidder Personnel and Experience Sheet. This Form is provided in this Project Manual. 5. Pre-Qualification Affidavit For all School Facilities Projects, irrespective of project cost, all bidders and those with subcontractors for plumbing and gas fitting work, heating and ventilating systems and equipment, electrical work and structural steel and prequalified by the New Jersey Economic Development Authority (EDA) and the New Jersey School Development Authority (SDA) to trade or work classification and aggregate rating limit, pursuant to N.J.S.A. 18A:7G-33 et seq. on which they may submit bids 6. Affidavit of No Material Adverse Changes The Affidavit of No Material Adverse Changes must be submitted, together with following attachments as to the contractor and the subcontractors in the five (5) major branches of work and all specialty trades for which classification is required: a. A NOTICE OF CLASSIFICATION from DPMC, as issued by the State of New Jersey, Department of Treasury, Division of Property Management and Construction (DPMC). b. Total Amount of Uncompleted Contracts, DPMC Form 701. c. Contractor or Trade License required under applicable New Jersey Law for any trade or specialty area in which the Bidder or subcontractor(s) will perform work. d. Bidder Certification to be submitted by the bidder and the subcontractors in the four major branches of work. 7. Statement of Ownership Disclosure All bidders must submit an Ownership Disclosure pursuant to N.J.S.A. 52:25-24.2 in the form provided in this bid package as a mandatory item with their bid. Failure to do so will result in the disqualification of the bid. 8. Affidavit of Non-Collusion All bidders must submit a completed Non-Collusion Affidavit in the form provided in this bid package as a mandatory item with their bid. Failure to do so will result in the disqualification of the bid. 9. State of New Jersey Debarred List Affidavit All bidders must submit a complete State of New Jersey Debarred List Affidavit on the form included in this bid package. Failure to do so will result in the disqualification of the bid. 10. Americans with Disabilities Act Certification The required form is provided in this bid package. Failure to submit this form will result in the disqualification of the bid. 11. Bidder's Affidavit The required form is provided in this bid package. Failure to submit this form will result in the disqualification of the bid THE BIDD ER'S CHECKLIST PROVIDED HEREIN SETS FORTH WHICH SUBMISSIONS ARE REQUIRED WITH THE SUBMISSION OF THE BID AND WHICH SUBMISSIONS ARE REQUIRED FROM THE SUCCESSFUL BIDDER. The following additional documents/items must be submitted by the successful bidder as described herein: 1. Federal Debarment Certification All bidders and listed subcontractors must submit, prior to contract award, a complete Federal Debarment Certification on the form included in this bid package pursuant to N.J.S.A. 52.32-44.1 2. Public Works Contractor Registration Act All contractors and listed subcontractors as defined in N.J.S.A. 34:11-56.48 et seq. submitting a bid for this project shall be registered with the Department of Labor in accordance with N.J.S.A. 34:11-56.48 et seq. and shall submit their certificate prior to contract award. 3. Business Registration Certificate Current valid Business Registration Certificate issued by the State Department of Treasury, Division of Revenue pursuant to N.J.S.A. 52:32-44 et seq. must be submitted prior to contract award. 4. Political Contribution Disclosure Form Pursuant to N.J.S.A. 19:44A-20.26, all bidders must submit a complete C.271 Political Contribution Disclosure 5. Affirmative Action Acknowledgement for Compliance with Affirmative Action Regulations The required form is provided in this bid package. Failure to submit this form after notice of award and prior to signing contract will result in the disqualification of the bid. 6. Iran Disclosure Form shall be submitted prior to contract award. 7. Certificate Regarding Prohibited Activities in Russia and Belarus shall be submitted prior to contract award. 8. Updated Insurance Coverage Certificate shall be submitted after contract award with executed contract. 9. Affidavit of Release of Liens and Indemnification shall be submitted after contract award with executed contract. 10. All Required Contract Bonds shall be submitted after contract award with executed contract. 11. Any other items for submission set forth in this Bid Package shall be submitted as indicated in the Instructions to Bidders and/or on the individual form. Bidders are notified as follows: 1. Notice of revisions or addenda to the advertisement or bid specifications will be sent in writing, via certified mail, certified facsimile transmission or delivery service to all persons who have picked up a copy of the bidding documents. Notice shall be provided no later than seven (7) days, Saturday, Sundays or holidays excepted, prior to the date for acceptance of bids to any person who has received a bid package. It shall be the responsibility of the Bidder to ascertain that he has received all properly issued notices of amendments, revision, or clarifications in accordance with NJSA 18A:18A-21(c). Failure to receive notice of any amendment, revision or clarification when good faith notice is sent or delivered shall not be considered failure by the District to provide notice and shall not relieve a bidder from any obligation under his bid. All amendments, revisions and clarifications shall become part of the contract documents. 2. Bidders are required to comply with the requirements of N.J.S.A. 10:2-1 et seq., "The Law Against Discrimination", N.J.S.A. 10:5-1 et seq., and N.J.A.C. 17:27-1.1 et seq. 3. No bidder who is on the State Treasurer's, the New Jersey Economic Development Authority's, the New Jersey School Development Authority's, or the Federal Government's List of Debarred, Suspended or Disqualified Bidders shall be eligible to bid on this project. In addition, no person nor the person's affiliates who is debarred at the federal level from contracting with a federal government agency shall be eligible to bid on this project in accordance with N.J.S.A. 52:32-44.1. 4. Bidders are notified that they must comply with provision s of N.J.S.A. 34:11 56 .25 et seq., (Wages on Public Works) and that the contract to be awarded in this case shall contain a stipulation that the wage rate to be paid to workers employed in the performance of the contracts shall not be less than the prevailing wage rate as determined by the Commissioner of the Department of Labor and Industry of the State of New Jersey. 5. Bidders are put on notice that the District is an exempt organization under the provisions of the New Jersey State Sales and Use Tax Act (N.J.S.A. 54:32B-1 et seq.) and is not required to pay sales tax. 6. All Bidders are put on notice that they are required to comply with all rules and regulations and orders. All Bidders Are Hereby Advised That the Project and Any Portion Thereof is Conditioned Upon the District Receiving All Necessary Approvals and All Necessary Funding Therefore.
