The County of Merrimack reserves the right to accept or reject any or all submissions and to accept, in part or in whole, any submission that it deems, at the County Administrator's discretion, to be in the best interest of the County. Additionally, the County of Merrimack reserves the right to cancel this Request for Proposals at any time and for any reason. Merrimack County accepts no liability for, and may not provide any accommodations to, respondents who fail to check for amendments and/or modifications to requests for bids or proposals and subsequently submit inadequate or incorrect responses. It is the sole responsibility of the potential respondent to ascertain the existence of any addenda and/or modification issued by the County. Questions Due to the County 8/3/2023 All questions and inquiries concerning this RFP must either be submitted in writing via electronic mail to Jonathan Gardner, Purchasing Manager, to jgardner@merrimackcounty.net or submitted through the BidNet Direct platform using the "Ask a Question" button. The County of Merrimack will address all questions submitted by the "Answers" deadline. Questions may be answered directly or in the form of an addendum, posted on the BidNet Direct platform and/or sent directly to known interested parties, including various Bid News Sites. The County of Merrimack reserves the right to waive all irregularities and formalities in the selection of the Contractor for this project. Performance and Payment Bond:
At the time of or prior to the execution of the contract, the County reserves the right to require the successful Offeror to furnish a Performance and/or labor and material Payment Bond with corporate surety, satisfactory to
the County of Merrimack, in the amount of the contract price.
