The total Contract Time will be 30 consecutive calendar days and the liquidated damages will be $1,000 per consecutive calendar day thereafter. Award will be made to the lowest and best bidder and the DeSoto County Regional Utility Authority reserves the right to reject any and all bids. The Authority reserves the right to reject any or all bids and to waive any informalities, technicalities or omissions therein. The Authority also reserves the right to reject bids from bidders that have pending litigation or claims with the Authority or that have pending or past litigation or claims with which the Authority is or has been involved as a third party, or if such bid includes a proposed subcontractor or supplier that has pending litigation or claims with the Authority or that have pending or past litigation or claims with which the Authority is or has been involved as a third party, if the Authority determines, in its sole discretion, such litigation or claims may adversely affect the ability of the parties to work efficiently and effectively under this contract, or for any other reason as determined by the Authority.
