The City reserves the right, where its best interest will be served, to accept or reject any conditional or qualified Bid. CONTRACT TIME AND LIQUIDATED DAMAGES: This project is to be completed, including cleanup, within 240 consecutive calendar days after the date to be specified in the Notice to Proceed, unless the contract time is adjusted by change order. The Contractor shall agree to pay to the Owner, as liquidated damages, the sum of $3,900.00 for each consecutive calendar day that the work exceeds the allotted contract time. CONTRACT SECURITY. A Performance and Payment Bond, on the form attached to these contract documents, in the amount of 100% of the Contract price, with a corporate surety approved by the City, will be required for the faithful performance of the Contract.
