Renovation of a transportation facility in Baltimore, Maryland. Completed plans call for the renovation of a transportation facility.
The work under this contract includes residential window and door replacement, HVAC system installation and associated electrical work, sheetrock installation, hazardous materials abatement and finish carpentry and painting. Late bids, late requests for modifications, or late requests for withdrawal will not be considered. MAA is not responsible for bids received late and will not receive any bids that are late. A State Equal Opportunity Officer will be available to discuss the Disadvantaged Business Enterprise Program. Appropriate auxiliary aids and service for qualified individuals with disabilities will be provided upon request. The Bid, if over $100,000.00, must be accompanied by a Bid Guaranty in the amount of five percent (5%) of the Bid Price in the name of the State of Maryland. The Bid/Proposal Affidavit shall accompany the bid. Performance and Payment Bonds in the amount of the Contract Price will be required of the successful Bidder. Assistance in obtaining Bid, Performance and Payment Bonds may be available to qualifying small businesses through the Maryland Small Business Development Financing Authority (MSBDFA). All pertinent regulations, ordinances, and statutes of the Maryland Aviation Administration, Maryland Department of Transportation, State of Maryland, Federal Aviation Administration, and Anne Arundel County will be rigidly enforced including but not limited to the following Federal requirements incorporated herein by reference: Buy America Preference: (Reference: 49 USC 50101) Foreign Trade Restriction: (Reference: 49 CFR part 30) Davis Bacon Requirements: (Reference: 2 CFR 200 Appendix II(D)) Affirmative Action Requirement: (Reference: 41 CFR part 60-4, Executive Order 11246) Governmentwide Debarment and Suspension: (Reference: 2 CFR part 180 (Subpart C), 2 CFR part 1200, DOT Order 4200.5 DOT Suspension & Debarment Procedures & Ineligibility) Governmentwide Requirements for Drug-free Workplace: (Reference: 7 CFR part 182) Disadvantaged Business Enterprise (DBE) Requirements It is the goal of the Maryland Department of Transportation (MDOT) that Disadvantaged Business Enterprises (DBE) participate in all contracts, and the Contractor is encouraged to utilize DBE subcontractors when there is opportunity to do so. MDOT hereby notifies all Bidders that in regard to any Contract entered into pursuant to this MS-IFB, DBEs will not be subject to discrimination on the basis of race, color, sex or national origin in consideration for an award. The MAA has established a minimum DBE participation goal as indicated below. MAA reserves the right to reduce the total contract dollars by the value of the sole source items for purposes of achieving the DBE goal. DBE Subcontractor Participation Goals. For the purposes of this Contract, a minimum overall DBE subcontractor participation goal of Twenty-Six percent (26%) of the total Contract dollar amount of the Contractors bid for this Contract has been established. By submitting a response to this solicitation, a Bidder agrees that, at a minimum, the established DBE goal will be performed by one (1) or more DBE firms, including the classifications of DBE specified. Failure to meet this DBE requirement will disqualify the Bidder from further consideration, or termination of a Contract once in progress. The contractor, subcontractor, or subrecipient (grant recipient) shall not discriminate on the basis of race, color, sex or national origin in performance of this contract. The contractor shall carry out applicable requirements of 49 CFR Part 26 in the award and administration of Federal DOT-assisted contracts . Failure by the contractor to carry out these requirements is a material breach of this contract, which may result in the termination of this contract or such other remedy as MDOT deems appropriate. Please be informed all bidders must furnish the names and address of the firms that submitted quotes for your bid and to include the age of the firm and annual gross receipts or revenues. The MAA will verify this information. This contract requires the contractor to make good faith efforts to comply with the Minority Business Enterprise/Disadvantaged Business Enterprise MBE/DBE Program and contract provisions. The Maryland Department of Transportation - Maryland Aviation Administration (MDOT/MAA) and the Contractor acknowledge and agree that MAA will incur damages, including but not limited to loss of goodwill, detrimental impact on economic development, and diversion of internal staff resources, if the contractor does not make good faith efforts to comply with the requirements of the MBE/DBE Program and MBE contract provisions. The parties further acknowledge and agree that the damages MAA might be anticipated to accrue as a result of such lack of compliance is difficult to ascertain with precision. Therefore, upon a determination by MAA that the contractor failed to make good faith efforts to comply with one or more of the specified MBE/DBE Program requirements or contract provisions, the contractor agrees to pay liquidated damages to the State at the rates set forth below. The contractor expressly agrees that MAA may withhold payment on any invoices as a set-off against liquidated damages owed. The contractor further agrees that for each specified violation, the agreed upon liquidated damages are reasonably appropriate to the loss the State is anticipated to incur as a result of such violation. A. Failure to submit each monthly payment report in full compliance with COMAR 21.11.03.13B (3): $42.37 per day until the monthly report is submitted as required. B. Failure to include in its agreements with MBE subcontractors a provision requiring submission of payment reports in full compliance with COMAR 21.11.03.13B (4): $148.30 per MBE/DBE subcontractor. C. Failure to promptly pay all undisputed amounts to a subcontractor in full compliance with the prompt payment provisions of the contract: $100.00 per day until the undisputed amount due to the subcontractor is paid. D.Failure to comply with COMAR 21.11.03.12 in terminating, canceling, or changing the scope of work/value of a contract with an MBE subcontractor and/or amendment of the MBE/DBE participation schedule: the difference between the dollar value of the MBE/DBE participation commitment on the MBE participation schedule for that specific MBE/DBE firm and the dollar value of the work performed by that MBE/DBE firm for the contract. E. Failure to meet the contractor's total MBE/DBE participation goal and Subgoal commitments; the difference between the dollar value of the total MBE/DBE participation commitment on the MBE participation schedule and the MBE/DBE participation actually achieved. NOTE: Maryland Aviation Administration (MAA) does not assess Section E of the MBE/DBE Liquidated Damages Provision to Indefinite Delivery Indefinite Quantity (IDIQ) Contracts, when MAA does not request the performance of a task for which an MBE subcontractor named on the Participation Schedule and qualified based on its NAICS Code. Notwithstanding the use of liquidated damages, the Maryland Department of Transportation - Maryland Aviation Administration reserves the right to terminate a task or contract and exercise all other rights and remedies provided in the contract or by law. By submitting a response to this solicitation, the Bidder agrees to accept payments by electronic funds transfer unless the State Comptrollers Office grants an exemption. The selected Bidder shall register with the EFT Registration, General Accounting Division form using the COT/GAD X10 Vendor Electronic Funds (EFT) Registration Request Form Any request for exemption must be submitted to the State Comptrollers Office for approval at the address specified on the COT/GAD X-10 form and must include the reason for exemption. By submitting a response to this solicitation, a vendor shall be deemed to represent that it is not in arrears in the payment of any obligation due and owing the State of Maryland, including the payment of taxes and employee benefits, and that it shall not become so in arrears during the term of the contract if selected for the contract award. The Maryland Aviation Administration reserves the right to reject any and all bids if in its judgment the interest of the MAA may so require.
