The City of Cathedral City is seeking proposals from qualified professional consultants and/or firms to provide services on Labor Compliance Monitoring and Enforcement pursuant to requirements of State prevailing wage law. The project in focus is the Dream Homes Park CIP No. 07021. Deadline for Submittal of Questions August 14, 2023, at 5:00 pm All questions regarding this RFP shall be submitted in writing to Andres Perez, via email at adperez@cathedralcity.gov. The date and time when questions must be submitted are shown in "Section IV - Schedule" of this RFP. Questions with their answers will be posted on the City website by the date and time set forth in this RFP. Questions via phone call will not be accepted. State Parks awarded the City of Cathedral City a Proposition 68 Statewide Park Development and Community Revitalization Program Grant in the amount of $8,498,000 for the design and construction of the Dream Homes Park. The park is to be built on a vacant 7.52-acre City-owned site in the Dream Homes neighborhood at San Diego Drive. The Project requires labor compliance monitoring and enforcement services on behalf of the City of Cathedral City. The Consultant is expected to provide weekly Labor Compliance Monitoring and Enforcement support services on or off site, as determined by the City Engineer. The anticipated length of the contract is two years. Typical services to be provided include, but are not limited to, the following: 1. Assisting Cathedral City in developing proper language for their contractor agreements to include the requirements of the State labor codes required for the project. 2. Contact the appropriate Project Manager to clarify the Labor Compliance requirements for the Project, answer all contractors' questions regarding the labor compliance requirements for this project. 3. Conduct a presentation discussing the applicable State labor laws and the contractual obligations of the Labor Compliance at the Project Pre-construction meeting with City of Cathedral City, contractor, and all subcontractors. 4. Provide in-service training to City of Cathedral City personnel, covering payroll collection and review, as well as labor compliance oversight. 5. Request and ensure receipt of weekly certified payroll records of all workers from the Contractors on the project. Compare the listed wage rate for every worker to the prevailing wage rates posted by DIR/DOL for each trade and work classification. 6. Regular communication with all parties is required to help keep violations to a minimum. 7. Uphold all apprenticeship requirements in ensuring proper standards are met by maintaining the qualifications of each contractor's Apprentice certifications, hours, and prevailing wage rates paid to all Apprentices employed on the project. Additionally, ensure the payment of training contributions to the applicable training committees as part of prevailing wage mandates. 8. Conduct site inspections and conduct random work site interviews with 2-3 workers per contractor using required site interview forms, as mandated by the State guidelines to investigate possible violations or claims filed by workers. Enter the information collected during these on-site interviews into a database for reference and for use in performing audits of the payroll records. 9. Promptly investigate any unresolved violations or claims of inadequate payment of wages or fringe benefits made by workers. Paycheck stubs, timecards, daily logs, and any other applicable payroll records must be requested from the Contractors and subcontractors and be compared with the submitted certified payrolls for the project. 10. Conduct additional worker interviews and maintain an open line of communication with workers on the project site in question. 11. Audit workers' compensation insurance coverage, apprenticeship training, and trust contributions, work hour records (including overtime wages), and illegal taking of wages. 12. If a violation is not remedied within 10 days of notification to the Contractor, prepare a report to City of Cathedral City requesting withholding of the subcontractors' payment until full compliance is met. 13. Submit monthly reports to City of Cathedral City describing in detail all prevailing wage oversight work performed during that month and identify any outstanding issues. 14. Consultant shall submit reports to DIR as required by the City of Cathedral City to satisfy all requirements for this project. Proposals shall be submitted in 8 1/2 " x 11" format. Submit one (1) Signed Original and a flash drive with an electronic copy of the Work Proposal. Submit one (1) Copy of the Cost Proposal in a Separate Sealed Envelope entitled Cost Proposal in the package containing the Work Proposal. Proposals must be signed by an official authorized to bind the firm and shall be valid for sixty (60) days. The City of Cathedral City reserves the right to: Cathedral City reserves the right to waive informalities and to reject all proposals at its sole discretion. Bidders are encouraged to keep their proposals brief and relevant to the specific work required. Award of contract September 13, 2023, or September 27, 2013 Cathedral City reserves the right to accept, reject, modify or cancel in whole or in part, this Request for Proposal. The City reserves the right to accept or reject any and all proposals, negotiate modifications to proposals that it deems acceptable, to request and consider additional information from any proposer and to waive minor irregularities and technical defects in this proposal process. The City reserves the right to seek new proposals when it determines that it is in the best interest of the City to do so. Subject to the provisions of Section 19 "Termination of Agreement" of this Agreement, the Term of this Agreement is for two (2) years commencing on the Effective Date. The method of Contractor Selection has not been Determined at this time.
