Checks shall be made payable to the Village of Suffern, New York, and are to be held by the Village as a guarantee for the proper execution and delivery of the Contract and Letter of Credit to secure the faithful performance thereof. In default of such execution and delivery of Contract and Letter of Credit with the above requirements within ten (10) days after the proposal shall have been accepted, the amount of the deposit represented by the check or bid bond shall be forfeited to and retained by the Village of Suffern as liquidated damages.
