The Lewiston Auburn Water Pollution Control Authority (LAWPCA) is required to construct a combined sewer overflow (CSO) storage tank to reduce the frequency and volume of CSO discharges into the Androscoggin River from Structure B and Outfall 002 located at the Wastewater Treatment Plant (WWTP). Lewiston Auburn Water Pollution Control Authority (LAWPCA) through this RFP for the LAWPCA CSO Storage Project (Project) invites Design Build Proposals from Proposers according to the requirements outlined in the RFP. By selecting a fixed-price design-build delivery method for this Project, the Proposer is committing to working in close collaboration with LAWPCA to achieve the Project objectives within the agreed fixed price. Outline of Work: The Lewiston Auburn Water Pollution Control Authority (LAWPCA) is required to construct a combined sewer overflow (CSO) storage tank to reduce the frequency and volume of CSO discharges into the Androscoggin River from Structure B and Outfall 002 located at the Wastewater Treatment Plant (WWTP). The WWTP is designed to handle an average daily flow of 14.2 million gallons per day (MGD) but currently treats an average daily flow of about 8 MGD. During wet weather, the WWTP often treats 20 to 25 MGD due to the combined sewers that serve Lewiston and Auburn. During wet weather events, the collection systems from Auburn and Lewiston can deliver flows approaching 50 MGD to the WWTP. Excess wet weather flow, above the peak flow capable of being treated through the full WWTP treatment process, overflows from Structure B to the Androscoggin River via a 48-inch outfall leading to Outfall 002. Control of overflows from Structure B is the subject of this design-build request for proposals (RFP). Structure B is located on the WWTP site. Incoming lines to Structure B include a 48-inch Lewiston influent sewer and a 24-inch sewer connection from Structure A. Outgoing lines from Structure B include the 60- inch main influent sewer to the WWTP and a 48-inch overflow to the Androscoggin River. The WWTP currently has sufficient influent pumping capacity to pump and treat a peak flow of 32 MGD. LAWPCA is currently advancing plans to increase the firm WWTP peak flow pumping and treatment capacity to 38 MGD. The 2.1-million-gallon (MG) capacity of the CSO Storage Facility, which is the subject of this design-build RFP, is based on the WWTP having a firm pumping and treatment capacity of 38 MGD. Proposers are advised that the 38 MGD pumping and treatment capacity will be provided separately from this design-build project. The services in this Contract include planning, engineering, design, permitting, and procurement of materials and equipment, construction, testing, start-up, and commissioning of the LAWPCA CSO Storage Facility for the off-line storage of 2.1 MG of CSO discharge from Outfall 002. Overflow from downstream of Structure B and upstream of the Outfall 002 discharge location shall be intercepted at a Diversion Structure and conveyed to a CSO Storage Pump Station with a firm capacity of 30 MGD. The CSO Storage Pump Station shall pump to the Storage Tank(s). Following each storm event, the Storage Tank(s) shall be dewatered by gravity back to the WWTP for full treatment. The Diversion Structure, CSO Storage Pump Station, and Storage Tank(s) shall be located within the limits shown on indicative drawing C-1 which is appended to Volume 2. Major facilities, components, and functions that make up the CSO Storage Facility are as follows: Diversion Structure CSO Storage Pump Station Storage Tank Ancillary piping (e.g., Diversion Structure to CSO Pump Station, CSO Pump Station to Storage Tank, Storage Tank drain, process water, etc.) Support Building, including a garage bay and an Electrical and Control Room Replacement of existing generator in existing generator room Project technical requirements for the major facilities, components, and functions that make up the CSO Storage Facility are presented in Volume 2 of the Request for Proposals (RFP). The Proposals will be reviewed and evaluated using the selection process described within the RFP and based on both price and non-price factors (best value). After the evaluation process, LAWPCA will select the highest-ranked Proposer to award or enter into negotiation for the award of, the Fixed-Price Design-Build Contract In no event would the Owner or its agents be liable for any costs incurred by any Proposer or any other party in developing or submitting a Proposal. It is anticipated that the Fixed-Price Design-Build Contract will be executed by early winter of 2023 or 2024 with design, permitting, construction, performance testing, and Substantial Completion of the Project shall be attained no later than January 9, 2026. Verbal communications expressed at the pre-proposal conference will not change the solicitation. Only an addendum issued to amend the solicitation or supplement the solicitation will be binding. Agency Not a Party:This contract is expected to be funded in part by the State of Maine Department of Environmental Protection (DEP) Clean Water State Revolving Loan Fund (CWSRF) program. Neither the State of Maine nor any of its departments, agencies, or employees is or will be a party to this contract. The word agency in the contract documents refers to the DEP and all other involved funding agencies. SRF Disadvantaged Business Enterprises Program: The Proposer must comply with the Disadvantaged Business Enterprises (DBE) SRF special requirements contained in the CWSRF Supplementary Conditions. Failure of the successful Proposer to complete the pre-award requirements of this program may result in finding that the Proposer is non-responsible and therefore not entitled to the award of this contract. Federal Requirements: The Proposer must comply with all Federal Requirements per the CWSRF Supplementary Conditions. Davis-Bacon and Related Acts: The Proposer must comply with Davis-Bacon (DB) and Davis-Bacon Related Acts (DBRA) as stated in the CWSRF Supplementary Conditions. All laborers and mechanics employed by the Proposer and subcontractors on this project shall not be paid less than the prevailing wage rates contained in the wage determination published in the bidding documents. Any laborers and mechanics not listed in the wage determination shall be paid at least as much as the lowest wage rate for other similar trade classifications already contained in the wage determination published in the bidding documents. American Iron and Steel: The Proposer shall comply with the Use of American Iron and Steel requirements on this project.
