It is the intent of the Owner to enter into a single contract for General Construction, which includes HVAC, plumbing, and electrical trades. Bids shall include a Bid Security Bond, payable to the Buhl Park Corporation, in an amount of ten percent (10%) of the bid, in accordance with Instructions to Bidders, as included in the Contract Documents. It is the intent of the Owner to enter into one (1) Contract for General Construction. 1. The entire Project and all information shown on the Contract Documents is being Bid under one General Contract. This contract includes all trades (i.e., General, HVAC, Plumbing, Electrical, etc.). Any reference to separate contractors (GC, HC, PC, EC, etc.) that may appear in the Contract Documents are usual references to the trade involved and may be a subcontractor to the General Contractor. Any reference to General Contractor, Contractor, Heating Contractor, Plumbing Contractor, Electrical Contractor, throughout the Contract Documents shall mean the General Contractor Such Bid Bond shall be submitted with the understanding that it shall guarantee that the Bidders Bid will not be withdrawn for a period of at least sixty (60) days after the scheduled closing time for receipt of bids; that if the Bid is accepted, the Bidder will execute the Form of Agreement, as provided by the Owner, with all blanks appropriately filled and will submit the required 100% Performance and Labor and Material Bonds (submitted on A.I.A. Document A312) and 100% Maintenance Bond as specified in Section 007216, Article 11; and that in the event of withdrawal of said Bid within said period, or the failure to enter into said Agreement and submit said Bonds within ten days after the Bidder has received notice of the acceptance of the Bid, the Bidder shall be liable to the above mentioned Owner for the full amount of such Bond as representing the damage to the Owner on account of the default of the Bidder in any particular hereof. The Bid Bond of all Bidders whose Bids are not accepted will be returned within ten calendar days after the scheduled bid opening date. 1. Contractors withdrawal of Bid: a. A bidder may only withdraw a bid if there is an honest and good-faith mistake (which must be supported by evidence) in the calculation of the bid price. A bidder has two business days from bid opening to withdraw a bid. b. The Owner reserves the right to accept or decline the Contractors Withdrawal of Bid Request and reserves the right to retain the bid bond. c. A bidder who withdraws a bid will not be permitted to bid on the project a second time (should it be rebid) or provide any work or materials to the project. d. If the Owner chooses to rebid the project, the bid bond of the withdrawing bidder will be forfeited to the Owner to supplement the rebid costs. The only electronic format Contract Documents will be available in is portable document format (pdf); Contract Documents will not be available in any of these electronic formats AutoCAD, Microsoft Word, Excel, etc Due to the fact that the project is financed, in part, by a grant from the Commonwealth of Pennsylvania, Contractors shall comply with all applicable Federal and State laws, regulations, and grant requirements. The term of this Grant shall commence on the Effective Date (as defined below) and shall end on JUNE 30, 2026, subject to the other provisions of this Grant.
