Roof Replacement at Hickory Ridge High School Bid Bond. Bid shall be in the form of AIA Document A310-2010 Bid Bond. The Bidder, at the time of submission of the bid, shall provide the bid bond in the specified form in the penal sum of not less than 5 percent (5%) of the bid sum. The bid bond shall be executed by a corporate surety licensed under the laws of North Carolina to execute such bonds, conditioned that the surety will upon demand forthwith make payment to the obligee (Owner) upon said bond if the bidder fails to execute the contract in accordance with the bid bond and North Carolina General Statutes. Performance and Payment Bonds. The Contractor, prior to the execution of the Agreement, shall provide performance and payment bonds in accordance with North Carolina General Statutes 44A-26, which shall each be in the amount of 100 percent of the contract sum. Bonds shall be in the form of AIA Document A312-2010 Performance Bond and separate Labor and Material Payment Bond, covering the faithful performance of the contract and the payment of all obligations arising thereunder. The bonds shall be executed by a responsible surety licensed in North Carolina and acceptable to the Owner, with ratings not lower than A and financial rating not lower than XII in the Best Insurance Guide, latest edition in effect as of the date of the Agreement. Bid security in the amount of 5 percent (5%) of the bid sum is required to be furnished at the time of submission of the bid. Acceptable bid guarantees are a Bid Bond, Cashiers Check, Certified Check, or other security, as stipulated by North Carolina General Statutes 143-129(b). Time is of the essence of the Agreement. The Work shall be completed as set out in the Agreement within the Contract Time as follows: A. Contract Time. The Contractor shall achieve Substantial Completion of the BASE BID Work not later than 180 consecutive calendar days from the date of Notice To Proceed.
