Public Safety Radio Tower Project Each bidder shall submit with its bid, a bid guarantee of five percent (5%) of its bid or an approved Bid Bond* in the amount of ten percent (10%) of the total bid (pursuant to SDCL 5-18B-2). *Bid Bonds must be issued by a surety authorized to do business in the state of South Dakota and must be made payable to the purchasing agency. Failure to furnish the required bid guarantee in the proper form and amount by the time set for opening of bids will be cause for rejection of the bid. The bid guarantee shall be in the form of a firm commitment, such as a bid bond, postal money order, certified check or cashiers check. Bid guarantees, other than bid bonds, will be returned to unsuccessful bidders within 30 days after the opening of bids (pursuant to SDCL 5-18B-9) and to the successful bidder upon acceptance of the conditional offer. The Lawrence County Board of Commissioners reserve the right to accept or reject any or all bids and to accept the bid which, in their opinion, is the best responsible bid or that which is deemed to be in the best interest of Lawrence County.
