Pipeline Operation & Maintenance. The BPU reserves the right to reject any or all bids, the right to waive any informalities, the right to permit exceptions deemed not to be of substance, and the right to accept any bid which the BPU deems to represent a prudent and economical expenditure of the public monies for the benefit of its customers by securing the maximum quality at the lowest possible cost. Except as may be expressly set forth herein, in no event shall either Party, be liable to the other Party for any treble, exemplary or punitive damages related to or arising out of the performance of this Agreement. To the extent any damages required to be paid hereunder are liquidated, the Parties acknowledge that the damages are difficult or impossible to determine, otherwise obtaining an adequate remedy is inconvenient and the liquidated damages constitute a reasonable approximation of the harm or loss.
