Each bid must be accompanied by a bid bond in an amount of 10% of the bid amount with a surety satisfactory to the aforesaid Director of Public Service, City of Chillicothe, Ohio or by certified check or cashier's check in the amount of not less than 10% of the bid amount in favor of the aforesaid Director of Public Service, City of Chillicothe, Ohio. Bid Bonds shall be accompanied by Proof of Authority of the official or agent signing the bond. Atention of bidders is called to all of the requirements contained in this bid packet, particularly to the State of Ohio Labor Standards Provisions including Prevailing Wage Rates, various insurance requirements, various equal employment opportunity provisions, and the requirement for a payment bond and performance bond for 100% of the contract price. The successful bidder, upon his/her failure or refusal to execute and deliver the contract and bonds required within ten (10) days after he/she has received notice of the acceptance of his/her bid, shall forfeit to the Owner, as liquidated damages for such failure or refusal, the security deposited with his/her bid. No bidder may withdraw his bid within sixty (60) days after the actual date of the opening thereof. The City of Chillicothe, Ohio reserves the right to waive any informality, change quantities, or reject any or all bids.
