In accordance with the specifications prepared by PCWA, the Work includes the furnishing of all labor, materials, tax, equipment and services to complete the installation of asphalt paving, concrete and associated work throughout Placer County as specified by PCWA personnel and all other work as specified within the Contract Documents. The total not to exceed amount for this contract is $1,200,000.00. Individual tasks will be defined and authorized on an as needed basis. The Agency does not provide any guaranty that a minimum or maximum amount of the full amount of the contract will be authorized. The Agency, at its sole discretion, may choose to award multiple contracts for these services. The total Contract Time is from January 1, 2024 through December 31, 2024. The contract may be extended through December 2025 at the sole option of the Agency. If such option is exercised, the bid items would be allowed to be increased for 2025 by an amount equal to the Engineering News Record (ENR) Construction Cost Index for San Francisco, during the period of November 1, 2024, through October 31, 2024. At the time the Contract is bid, awarded and for the duration of the contract, the Owner has determined that the General Contractor shall possess a valid State of California Class A General Engineering Contractor's License, or both C-8 Concrete and C-12 Earthwork & Paving Contractor's Licenses. Failure to possess the specified licenses shall render the bid as nonresponsive. Bidders must comply with the provisions of the Business and Professions Code Section 7028.15 by setting forth their license number and expiration date on their bid. The Bidder is required to register with Public Purchase to obtain the Contract Documents and become a listed holder of these documents to be eligible to bid the Project. Bids received from Bidders not following these procedures may, in the discretion of the Owner, be deemed nonresponsive. The Owner, in making copies of the Contract Documents available on the above terms, does so only for the purpose of obtaining Bids for the Work and does not confer license or grant for any other use. Procedural questions regarding the Contract Documents and/or obtain a plan holders list should be directed to the Placer County Water Agency Engineering Division at (530) 823-4886. Complete sets of Contract Documents must be used in preparing Bids. The Owner does not assume responsibility for errors or misinterpretations resulting from the use of incomplete sets of Contract Documents. Bidding procedures are prescribed in the Contract Documents. Bids shall be executed upon the Bid Forms bound and made a part of the Bid Documents. All prescribed Bid Forms may be removed from the Contract Documents for submission in a sealed envelope. The bid form shall be accompanied by a bid guaranty bond provided by a surety company authorized to carry on business in the State of California with a minimum "A" rating with Best's Rating Guide for payment to the Owner in the sum of at least ten percent (10%) of the total amount of the bid price, or, alternatively, by a certified or cashier's check, payable to the Owner in the sum of at least ten percent (10%) of the total amount of the bid price. The bid guaranty bond shall be provided on the form included in Section 00410, BID GUARANTY BOND, of this Project Document. The amount payable to the Owner under the bid guaranty bond, or the certified or cashier's check and the amount thereof, as the case may be, shall be forfeited to the Owner as liquidated damages in case of a failure or neglect of the bidder to furnish, execute, and deliver to the Owner the required performance and payment bonds, evidences of insurance; and to enter into, execute, and deliver to the Owner the Agreement on the form provided herewith, within ten (10) calendar days after receiving written notice from the Owner that the award has been made and the Agreement is ready for execution. The bid guarantees of the three lowest Bidders will be retained until the Agreement is signed, evidence of insurance provided, and satisfactory bonds furnished or other disposition made thereof. The bid guarantees will be returned to all but the lowest three responsive bidders upon written request from the Bidder. The bid guarantees from the lowest three bids will be available for return at the time they are considered null and void per terms of the Bid Guaranty Bond. The successful Bidder will be required to furnish both a Faithful Performance Bond in the amount of one hundred percent (100%) and a Payment Bond in the amount of one hundred percent (100%) of the Contract price. Pursuant to Sections 1770, et seq., of the California Labor Code, the successful Bidder shall pay not less than the prevailing rate of per diem wages as determined by the Director of the California Department of Industrial Relations. Pursuant to the provisions of California Labor Code Section 1773.2, the Contractor is hereby advised that copies of the prevailing rate of per diem wages and a general prevailing rate for holidays, Saturdays and Sundays and overtime work in the locality in which the work is to be performed for each craft, classification, or type of worker required to execute the Contract, are on file in the Owner's office. All contractors and subcontractors shall be registered with DIR pursuant to Labor Code Section 1725.5 to be qualified to bid on this project or to be listed as a subcontractor for this project pursuant to Public Contract Code Section 4104. Bidders will be required to submit proof of registration for themselves and all listed subcontractors with their bid. The successful contractor and its subcontractors shall employ the appropriate number of apprentices, in each apprenticeable craft, on the project site as stipulated in California Labor Code 1777.5. The successful Bidder must insure that its policies and practices provide equal opportunity to all applicants and employees without regard to race, color, creed, sex, age, religion, ancestry, citizenship, national origin, handicap, mental condition, veteran or marital status. The successful Bidder must comply with the Americans with Disabilities Act. The successful contractor and its subcontractors shall employ the appropriate number of apprentices, in each apprenticeable craft, on the project site as stipulated in California Labor Code 1777.5. The successful Bidder must insure that its policies and practices provide equal opportunity to all applicants and employees without regard to race, color, creed, sex, age, religion, ancestry, citizenship, national origin, handicap, mental condition, veteran or marital status. The successful Bidder must comply with the Americans with Disabilities Act. Pursuant to Public Contract Code Section 22300, for monies earned by the Contractor and withheld by the Owner to ensure the performance of the Contract, the Contractor, may, at its option, choose to substitute securities meeting the requirements of Public Contract Code Section 22300, or have the retained, earned monies deposited in an escrow account at a federal or state chartered bank. No bid received and read aloud may be withdrawn for a period of sixty (60) days after the bid opening date, except pursuant to Public Contract Code Section 5101 et seq. Telephones will not be available to Bidders at the Owner's offices for the preparation of bids or for communicating bid results. Bid forms received after the designated time will not be opened and will be returned to the Bidder unopened. Bidders shall develop and submit bids at their own expense. The Owner will not reimburse any costs associated with the development and submittal of any and all bids. The Owner reserves the right to award the Contract, to reject any and all Bids, to waive irregularities, and to reject nonconforming, nonresponsive or conditional Bids.
