Upstate is requesting proposals from qualified contractors ("Parking Operator" or "Bidder") to provide parking management services ("Parking Operation") as outlined in this RFP. Upstate seeks a Parking Operator to provide services similar to the current arrangement that Upstate has under their current agreement for parking management services. Under the proposed continuation of a format similar to Upstate's current arrangement, a Parking Operator will support the management of all the parking operations at Upstate, including business office activities. The parking management services arrangement would allow for reimbursement of expenses to the Parking Operator, within agreed upon terms and limitations established in this RFP, and the payment of a management fee. Within ten (10) days of execution of the Resulting Agreement, successful Bidder must deliver to Upstate an executed standard performance bond, with approved surety, payable to Upstate in the amount of $200,000. It is understood that the bond will be guarantee of the faithful performance by successful Bidder of its obligations agreed to and contained in the Resulting Agreement. No agreement will be deemed in effect and no payment will be due and payable to the successful Bidder, even if the agreement has been performed in whole or in part, until the bonds have been delivered and approved by Upstate. Question Deadline 12/12/2023 at 2:00 PM ET Anticipated Contract Start Date August 1, 2024 Anticipated Term Length of Contract Five (5) Years The successful Bidder (Contractor) understands and agrees that it is responsible for the performance of the Services in accordance with the terms and conditions of the awarded Contract. Upstate may look solely to the Contractor for remedy, redress, liability or indemnification for any failure to perform, whether caused by Contractor itself or by one or more of its officers, employees, subcontractors, agents, licensees, licensors or affiliates or any person or entity acting on behalf of Contractor in providing the Services. The Contractor shall be fully liable for the actions of its officers, employees, subcontractors, agents, licensees, licensors, or affiliates or any person or entity acting on its behalf in providing the Services and shall fully indemnify and save harmless Upstate, SUNY and the State of New York from suits, actions, damages and costs of every name and description presented, brought, or recovered against Upstate, SUNY and the State of New York for, or on account of any liability which may be incurred by reason of the Contractor's performance of this Agreement Upstate currently employs the AIM parking management software system, but reserves the right to change at any time. In the event Upstate changes its parking management software system during the term of a Resulting Agreement, Upstate would still supply the software system and equipment to the successful Bidder without charge.
