Clearing and Grubbing to Serve Meadows. The project includes clearing and grubbing for future single family residential subdivision and storm water detention facilities. liquidated damages and other amounts due under this Contract, such balance shall be paid to the Contractor. If such costs exceed the unpaid balance, the Contractor shall pay the difference to the Owner. The amount to be paid to the Contractor or Owner, as the case may be, shall be certified by the Engineer, upon application, and this obligation for payment shall survive termination of the Contract. The OWNER reserves the right to reject any or all bids and to waive informalities and irregularities in bidding. Contract award will be made to the responsible bidder who, in the OWNER'sjudgment, will be most advantageous to the OWNER and result in the best and most economical completion of the project Proposals must be accompanied by a certified or cashier’s check or a bid bond from a surety company holding a permit in the State of Texas for an amount equal to 5% of the amount bid. The successful bidder must furnish a performance bond and a payment bond on the forms provided, each in the amount of 100% of the Contract price from a surety company licensed by the State of Texas.
