The undersigned, having familiarized himself/herself/themselves with the local conditions affecting the cost of the work, and with the Advertisement, the Form of Proposal, Specifications and Plans on file in the Department of Public Works, hereby proposes to perform everything required to be performed and to provide and furnish all the labor, materials, necessary tools, expendable equipment, and all utility and transportation services necessary to perform and complete in a workmanlike manner all the work required for portable toilet services and related work in the City of Niles, all in accordance with the specifications as prepared by Joseph Ray, Public Works Director The portable toilet firm shall provide standard portable toilets and ADA portable toilets (where applicable) or other approved equal portable toilets that are suitable for use in a neighborhood park setting, of suitable size, appearance, and construction design to handle the needs of each park. During each cleaning the firm shall inspect and restock the supplies in each toilet to ensure that there is toilet paper and/or hand sanitizer in their respected dispensers. The number of portable toilets per park varies depending on scheduled activities, the season, or the volume of park usage. Toilets shall be placed at locations as designated by the City. To prevent theft or vandalism, it is recommended that a cable be used to secure the portable toilet to a fixed object. Toilet cleaning frequency varies by park, but cleaning shall be completed no less than once per week. During times that toilets are heavily used, some locations may require additional cleanings (more than once per week). The city shall notify the portable toilet firm that said location needs an additional cleaning and the portable toilet firm shall clean said toilet at the bid additional cleaning price. When toilets are emptied and cleaned, if any waste is washed out onto the ground it shall be picked up and disposed of at the same time. At any time that a portable toilet driver arrives at a cleaning location and finds a portable toilet damaged, he/she shall report it to a supervisor, who will then arrange for a replacement portable toilet to be delivered as soon as possible. For most park locations, portable toilet needs are seasonal, beginning in early spring and ending in the fall. In early spring, the City will contact the portable toilet firm at an appropriate time and request that service be started. At that time the firm shall deliver the toilets to locations designated by the City. Normally this is a phased process, and not all toilets are needed at one time for all locations. When the season ends, designated seasonal toilets shall be picked up and hauled away by the portable toilet firm. All bidders are required to sign a certification that they will comply with all Federal and State nondiscrimination laws and regulations. The City reserves the right to reject any or all proposals, to waive irregularities in proposals and to accept the proposal which in the opinion of the City Council is most advantageous to the City. No bid shall be withdrawn after the opening of bids for a period of thirty (30) days after the scheduled time of receiving bids. Should a bidder find discrepancies in or omission from the contract documents, plans or specifications, or should he be in doubt as to their meaning, he may at once notify the Public Works Director, and request an interpretation thereof and he will be held responsible for the prompt delivery of such request. The Director of Public Works will thereupon send written instructions in an addendum to all bidders. The City will not be responsible for any oral instruction in connection with this contract. The City reserves the right to accept any proposal, or reject any or all proposals, and to waive defects or irregularities in any proposal. In particular, any alteration, erasure, or interlineations in the contract documents which are attached hereto and specifically made a part of these instructions and of the form of proposal, shall render the accompanying proposal irregular and subject to rejection by the City. The City will also consider as irregular and subject to rejection proposals that are clearly unbalanced. The contract period for this work shall be 5 years (60 months). The contract may be extended on a year to year basis, provided that both the City and the Contractor mutually agree to the terms of the extension(s). The above contact period shall begin on January 1st , 2024 and continue for a period of 5 years (60 months), expiring on December 31 st , 2028. This contract may be extended on a year to year basis, provided that both the City and the Contractor mutually agree to the terms of the extension.
