City reserves the right to request a best and final offer upon completion of negotiations. NO FAXED OR EMAILED BIDS! All documents (forms) herein and attached are required to be completed and returned with response. All questions must be answered within the Ion Wave Question & Answer segment. No emailed, faxed or phone call question related to this bid will be responded to. The deadline for submitting questions on this bid is November 13, 2023 at 5:00 p.m. This is an evaluated bid. Please pay close attention to the GP&L Construction Contractor Questionnaire and complete it and provide all documentation requested in an organized response. A Bid Bond in the amount of 5% is required with your bid response. Failure to provide a Bid Bond with your bid response could deem your bid non-responsive. A Performance, Payment and Maintenance Bond (2 yr.) will be required upon notification of award. Please acknowledge the City of Garland Terms and Conditions in the "Attributes" section. Please complete the GP&L Construction Contractor Questionnaire and upload it with your bid response. If additional pages were needed to answer the questions, please upload them as well. Failure to complete and provide answers to all of the questions required on the GP&L Construction Contractor Questionnaire could deem your bid nonresponsive. Conflict of Interest Form CIQ (1) Do you have a conflict of interest to report outlined in Chapter 176 of the Local Government Code If yes please complete Form CIQ via the following link and upload with your bid response: Local Government Code 176.006(a) and (a-1) (a) A vendor shall file a completed conflict of interest questionnaire if the vendor has a business relationship with a local governmental entity and: (1) has an employment or other business relationship with a local government officer of that local governmental entity, or a family member of the officer, described by Section 176.003(a)(2)(A); (2) has given a local government officer of that local governmental entity, or a family member of the officer, one or more gifts with the aggregate value specified by Section 176.003(a)(2)(B), excluding any gift described by Section 176.003(a-1); or (3) has a family relationship with a local government officer of that local governmental entity. (a-1) The completed conflict of interest questionnaire must be filed with the appropriate records administrator not later than the seventh business day after the later of: (1) the date that the vendor: (A) begins discussions or negotiations to enter into a contract with the local governmental entity; or (B) submits to the local governmental entity an application, response to a request for proposals or bids, correspondence, or another writing related to a potential contract with the local governmental entity; or (2) the date the vendor becomes aware: (A) of an employment or other business relationship with a local government officer, or a family member of the officer, described by Subsection (a); (B) that the vendor has given one or more gifts described by Subsection (a); or (C) of a family relationship with a local government officer. Bid Bonds A copy of the prospective vendors Bid Bond in the amount not less than five percent (5%) of the maximum bid price payable with recourse to the City of Garland, from a reliable surety company as a guarantee that the bidder will enter into a contract and execute the Performance Bond, Payment Bond and Maintenance Bond within ten (10) days after notice of award of contract, should be uploaded with this bid. Prevailing Wage Rates Contractors are required to comply with Texas Government Code Chapter 2258, Prevailing Wage Rates. For the purposes of work performed pursuant to public works contracts, contractors are required to pay not less than the prevailing wage rates as determined by the United States Department of Labor in accordance with the Davis-Bacon Act (40 U.S.C. Section 276a et seq.), and its subsequent amendments. The City of Garland has adopted the general prevailing rate of per diem wages for Dallas County, Texas as set by the United States Department of Labor Davis and Bacon Wage Determination, which are reported and updated from time-to-time at and at the Wage Determinations website
