By submitting a proposal, each proposer agrees to waive any claim it has or may have against the Owner, the Architect/Engineer, Construction Manager and their respective employees, arising out of or in connection with the administration, evaluation, or recommendation of any proposal; waiver of any requirements under the proposal documents; or the contract documents; acceptance or rejection of any proposals; and award of the Contract. The Owner, Architect and Construction Manager reserve the right to accept any proposal, to reject any and all proposals, or to negotiate contract terms with the various Proposers, when such is deemed by the Owner, Architect and Construction Manager to be in his best interest. Each Proposer shall submit with the proposal, a completed and up-to-date Subcontractor's Qualification Statement, unless such forms have been presented to the Construction Manager within 60 days prior to the proposal. Copy of this form is included at the end of this section. Notwithstanding any delay in the preparation and execution of the formal contract agreement, each Proposer shall be prepared, upon written notice of proposal acceptance, to commence work on or before a date stipulated in an official written order from the Construction Manager. The accepted Proposer shall assist and cooperate with the Construction Manager in preparing the formal contract agreement, and within 10 days following its presentation shall execute same and return it to the Construction Manager. Form for the contract agreement will be as stipulated in the Construction Manager's Special Conditions for Trade Contractors and Suppliers and included in the specifications. SALES TAX EXEMPTION The Owner qualifies for exemption from State and Local Sales Taxes as set forth in the Owner-Construction Manager Agreement. PROJECT DESCRIPTION This report presents the results of the geotechnical investigation conducted for the proposed new Roanoke Police/Municipal Court that is to be located on the southwest quadrant of the intersection of Park Drive and Fairway Drive in Roanoke, Texas. The project consists of the design and construction of a new main building with a footprint of about 45,300 square feet (sf) that will be utilized for Police and Municipal Court functions, a 14,700-sf combined range/support building, and associated pavements on an approximate 5.5-acre parcel of land. At the time of this field investigation, the project site was covered with short grass. Based upon visual site observations and available topographic maps (dfwmaps.com), the proposed site area appears to slope down from the west side to the east side with a topographic relief of about 6 feet. Final grading plans were not available during the time of this report preparation. We anticipate that the finished pad elevation will be achieved by some amount (within about 2 feet) of cut/fill operations. Recommended design parameters provided herein should be expected to change should there be significant quantities of cut or fill; therefore, we recommend that this office be permitted to review final grading and design plans prior to construction to confirm and/or revise the conclusions and recommendations provided herein.
