Other Details In accordance with Federal Code of Regulations, Section 200.321 (Contracting with small and minority businesses, women's business enterprises, and labor surplus area firms.), the Bidder must take all necessary affirmative steps to assure that minority businesses, women's business enterprises, and labor surplus area firms are used when possible. Affirmative steps taken by the Bidder must include: 1) Placing qualified small and minority businesses and women's business enterprises on solicitation lists. 2) Assuring that small and minority businesses, and women's business enterprises are solicited whenever they are potential sources. 3) Dividing total requirements, when economically feasible, into smaller tasks or quantities to permit maximum participation by small and minority businesses, and women's business enterprises. 4) Establishing delivery schedules, where the requirement permits, which encourage participation by small and minority businesses, and women's business enterprises. 5) Using the services and assistance, as appropriate, of such organizations as the Small Business Administration and the Minority Business Development Agency of the Department of Commerce. To document the Bidder's good faith effort in taking the above affirmative steps during bidding, the DBE GOOD FAITH EFFORTS VERIFICATION forms (See pages P-22 through P-24) have been included within the bid forms and must be completed by the Bidder and submitted at time of bidding to be eligible for Contract Award. Each bid shall be accompanied by cash, a certified or cashier's check, or a Bid Bond secured from a surety company satisfactory to the District. the amount of which shall not be less than ten percent (10%) of the submitted Total Bid Price, made payable to the District as bid security. The bid security shall be provided as a guarantee that within ten (10) calendar days after the District provides the successful bidder the Notice of Award, the successful Bidder will enter into a contract and provide the necessary bonds and certificates of insurance. The bid security will be declared forfeited if the successful Bidder fails to comply within said time. No interest will be paid on funds deposited with District. The bid security must be provided to the District at the District's headquarters at 42135 Winchester Road, Temecula, California 92590 prior to the deadline for receipt of Bids. Award of Contract: The District shall award the Contract for the Project to the lowest responsive, responsible bidder, as determined from the base bid alone by the District. The District reserves the right to reject any or all bids or to waive any irregularities or informalities in any bids or in the bidding process. If two or more bids are submitted with the same lowest bid amount, District may award the Contract to the bidder it chooses.
