Every bid shall be accompanied by a bid deposit in an amount not less than 5% of the value of the bid, including any and all alternates. Bid deposits shall be in the form of a bid bond, or cash, or a certified check on, or a treasurer’s or cashier's check issued by, a responsible bank or trust company and payable to the Town of Arlington. Bidders are reminded that the bid deposit covers the Town for damages when a Bidder withdraws its bid after the bid deadline. The Town will retain all bid deposits for withdrawn bids to the extent permitted by law.The successful Bidder will be required to furnish, within 10 days of notification of contract award, a Labor and Materials or Payment Bond in the amount of 50% of the contract amount. The Town will reject any and all bids when required to do so by Massachusetts General Laws. The Town reserves the right to waive any informalities in, or to reject any and all bids, if it deems it to be in the public interest so to do. The Town also reserves the right to reject any bid if it determines that such bid does not represent the bid of a person or firm competent to perform the work as specified, or if fewer than three bids are received, or if bid prices are not acceptable without further competition. Minimum Wage Rates, as determined by the Director of the Massachusetts Department of Labor Standards under the provisions of M.G.L. c.149 §§26 to 27H, shall prevail in the execution of the work of this project. The schedule of wage rates applicable to this contract is included in the bid and contract documents The Bidder must agree to commence work within five (5) business days from the date of signing the contract. Contract Period #1 will begin January 1, 2024, and end June 30, 2024.
