Mill Street Substation Steel Package. Description of Project: The Kansas City Board of Public Utilities (BPU) is requesting proposals from interested proposers for the procurement of the Mill Street substation steel package. The steel package includes two (2) monopole deadends, one (1) H-Frame deadend structure, three (3) static masts, various switch stands, one (1) CCVT stand, and bus support structures. All are to be manufactured according to the provided specifications and relevant project drawings. Alternate Proposals with value engineering options (e.g. for improved cost, lead time, size/weight, etc.) may be submitted only if accompanied by a Base Proposal that conforms to the specifications herein. If the Seller does not have the capabilities to manufacture all of the equipment, it will be the Sellers responsibility to coordinate a Subcontractor. Design schedule to be coordinated with Seller after award. Accurate lead times for the delivery of the equipment after the award of the project is due with the proposal. During the term of this Agreement, Contractor shall maintain a complete set of accounting records associated with this Agreement's Scope of Work. Accounting records shall be in a format that conforms to generally accepted accounting principles. Contractor shall clearly identify the scope of work that will be provided by the subcontractor along with estimated percentage of work to be completed by subcontractor. Liquidated Damages If Contractor (1) fails to deliver the engineering/document deliverables on the dates set forth herein, and in the manner this Agreement specifies, (2) fails to deliver the material/equipment deliverables on the dates set forth herein, or (3) fails to deliver the construction deliverables on the dates set forth herein, Purchaser and Contractor agree Purchaser would be damaged. As it would be almost impossible to ascertain the actual damages precisely due to the failures described in the prior sentence, Contractor agrees to pay delay liquidated damages in the amounts listed below (which shall not be construed to limit Contractor's other obligations or liabilities under this Agreement). Purchaser and Contractor agree any and all sums payable under this Section SC-3 are in the nature of liquidated damages and not a penalty. A. If Contractor fails to meet the delivery dates for the engineering/document deliverables listed herein, then Contractor shall pay to Purchaser liquidated damages of Five Hundred Dollars ($500) per day per individual drawings, data, information, manuals or package, until delivery of the same has occurred. B. If Subcontractor fails to meet the delivery dates for the material/equipment deliverables listed herein, then Contractor shall pay to Purchaser liquidated damages of $750 per day until delivery of the same has occurred. C. The maximum aggregate liquidated damages payable under this Agreement shall not exceed twenty-five percent (25%). The BPU reserves the right to reject any or all Proposals and waive irregularities therein, and all Proposers agree that such rejection shall be without liability on the part of the BPU for any penalty of any kind brought against the BPU because of such rejections. By filing any Proposal in response to this invitation, Proposer agrees to these conditions. The BPU is not obligated to request clarifications or additional information but may do so at its discretion. The BPU reserves the right to extend the deadline for submittals for all Proposers. Work Included: Detail and design; furnish, fabricate, and mark for erection identification; pack, crate or otherwise properly prepare for shipment and ship to site all required structural steel indicated on the Drawings and as further described in these Specifications. Bid Bond 5% M/WBEs are encouraged to participate in the bid process. Question Deadline 12/13/2023 Proposers may request additional information in writing about the project. All questions must be submitted to the Department of Purchasing & Supply Chain (jbagby@bpu.com and purchasing@bpu.com). Answers to all questions will be compiled and distributed as an Addendum on website. RFP deadline for submitting proposals has been extended from December 28, 2023 at 12:00 PM CST to January 5, 2024 @ 12:00 PM CST.
