**As of September 11, 2024, project not yet awarded.** Contractors are hereby notified that they must have proper license under the State laws governing their respective trades and that North Carolina General Statute 87 is observed in receiving and awarding contracts. General Contractors must have a general license classification for S (Marine Construction) or Building Contractor. No bid may be withdrawn after the opening of bids for a period of 30 days. The Owner reserves the right to reject any or all bids and waive informalities. Only submit bids using the BID/ACEPTANCE form provided herein. Properly insert information where indicated and execute with the appropriate signatures. Email bids in PDF format in lieu of delivering an original. Shade seals on emailed Bid/Acceptance forms so they are visible in the PDF. Contact David Hoffelt, GGEP to verify receipt of bids. Upon notification, the apparent low bidder mails a Bid/Acceptance form with original signatures to DEQ Division of Facilities, Health and Safety at the address indicated. The Contractor shall commence work to be performed under this Contract on a date to be specified in written order from the Designer/Owner and shall fully complete all work hereunder within 90 consecutive calendar days from the Notice to Proceed. For each day in excess of the above number of days, the Contractor shall pay the Owner the amount of Fifty Dollars ($50.00) as liquidated damages reasonably estimated in advance to cover the losses to be incurred by the Owner should the Contractor fail to complete the Work within the time specified. If the Contractor is delayed at any time in the progress of his work by any act or negligence of the Owner, his employees or his separate contractor, by changes ordered in the work; by abnormal weather conditions; by any causes beyond the Contractor's control or by other causes deemed justifiable by Owner, then the contract time may be reasonably extended in a written order from the Owner upon written request from the contractor within ten days following the cause for delay. Time extensions for weather delays, acts of God, labor disputes, fire, delays in transportation, unavoidable casualties or other delays which are beyond the control of the Owner do not entitle the Contractor to compensable damages for delays. Any contractor claim for compensable damages for delays is limited to delays caused solely by the owner or its agents. GS 143-128.2 establishes a ten percent (10%) goal for participation by minority business in total value of work for each State building project. For construction contracts with a value of less than $300,000, the Owner has the responsibility to make a good faith effort to solicit minority bids and to attain the goal. The contractor shall include with his bid a completed Identification of HUB Certified/Minority Business Participation form. Contractor shall submit completed Appendix E MBE Documentation for Contract Payments form with final payment request. For construction contracts with a value of $300,000 or greater, the contractor shall comply with the document Guidelines for Recruitment and Selection of Minority Businesses for Participation in State Construction Contracts including Identification of Minority Business Participation, Affidavits A, B, C, and D, and Appendix E. These forms provided herein are hereby incorporated and made a part of this contract. Masonboro Island is home to beach uplands, sand dunes, maritime grasslands, maritime shrub thickets, salt marsh and tidal flats. The construction limits are fully contained within the Reserve and are classified as a protected environmental area within the salt marsh. Lunar tides flood the intertidal salt marshes twice each day. Supratidal marshes remain above water except during occasional spring tides and storm tides. Cordgrass dominates the intertidal salt marsh. It constantly adapts to dramatic changes in salinity and temperature. This abundant, tall plant regulates salt concentrations in its cells by releasing excesses through pores on its blades. Other plants that compete for higher ground in the supratidal marsh include black needle rush, sea oxeye, salt grass and seaside aster. The construction limits are also within a protected research area where data has been collected for decades. Research walkway segments are temporary platforms that provide access to monitoring stations, or data collection points, to assess sea rise and impacts on vegetation within the salt marsh. Disruption of grades by either construction activity or foot traffic compromises the historical data set and adversely impacts laboratory analyses. Exercise extreme care while implementing the scope of work to protect the integrity of the data set. Pipe markers set in the field indicate the beginning and end of each walkway segment. Navigating outside the inner coastal waterway, depths enroute to the construction limits vary from about 4 feet of water to zero clearance. Store, stage and prepare material for installation on a stationary barge remote from locations of research walkway segments. Use shallow draft skiffs to transport personnel and material from the barge to research walkway termination points. Personnel traversing the salt marsh are to wear "snow shoes" until walk boards are in place. Minimize foot traffic in the salt marsh by using installed segments of the research walkway to access work in progress. Limit salt marsh traffic to the northern side of each research walkway segment. Do not walk or disturb grades on the southern side of each segment to protect the integrity of data collection. Provide temporary walk boards that avoid the cordgrass or are elevated above the cordgrass to set supporting posts. Use short walk boards in highly trafficked areas to distribute point loads across the mud and minimize disturbance at grade. Collect debris and return walk boards to the barge daily.
