A timeline for award has not yet been established.** The scope of work generally includes the following principal elements: Furnish and install a 2 million gallon elevated water tower complete with foundation and appertenaces as outlined in the plans and specifications. Four hundred eighty days (480) consecutive calendar days are allowed for completion of the Work. Liquidated damages for non-completion of the work within the time agreed upon will be assessed in accordance with the terms of the Contract. All bidders must furnish a bid bond on any contract exceeding $10,000 and may be required on amounts less than $10,000 at the discretion of the locality; provided that bonding is available for such services, equipment or materials. The amount of such bond shall be specified in the advertisement for bids except that on contracts exceeding $100,000 the bid bond shall not be less that five percent of the bid price. The bid bond shall consist of a "guarantee" such as a bond, certified check, or other negotiable instrument accompanying a bid as assurance that the bidder will, upon acceptance of his/her bid, execute such contractual documents as may be required within the time specified. All bids shall be submitted in the Contract Specification Book issued by the Engineer. Bids not submitted in the Contract Specification Book will not be opened. No Contract Documents will be issued later than twenty-four (24) hours prior to the time indicated above for receiving bids. A Performance Bond, in the form and terms approved by North Baldwin Utilities and in an amount not less than the total amount bid, shall be required prior to Contract execution. Contractor shall furnish prior to Contract execution a certificate of insurance coverage as provided in the Specifications which will include Comprehensive Insurance, Contractor's Automobile Liability Insurance, Owner's Protective Liability Insurance, and where applicable, subcontractor's Public Liability and Property Damage Insurance. All bidders may be required to furnish a performance bond on any contract. The amount of such bond shall be specified in the advertisement for bids except that on contracts exceeding $100,000 such bond shall be not less than 100 percent of the contract price. It is expressly agreed that the Bond shall be deemed amended automatically and immediately, without formal or separate amendments hereto, upon amendment to the Contract, not increasing the Contract price more that 20%, so as to bind the Principal and the Surety to the full faithful performance of the contract as amended. Contractors are hereby notified that they are encouraged, to the greatest extent practicable, to purchase American-made equipment and products with funding provided under this award. The right is reserved, as the interest of the Owner may require, to reject any and all bids, to waive any informalities in bids received, and to award in its best interests. A payment bond or surety bond is one executed in connection with a contract to assure payment as required by law of all persons supplying labor and material in the execution of the work provided for in the contract. All nonresident contractors preparing bids shall submit with the bid documents evidence of a current Alabama Business License, evidence of proper registration with the Alabama Secretary of State (with original seal of the State of Alabama), as a foreign corporation, and a Certificate of Good Standing as a Foreign Corporation from the State Department of Revenue. Bids submitted by a nonresident contractor without these documents included will be rejected. All bidders must comply with the President's Executive Order Number 11246 which prohibits discrimination in employment regarding race, creed, color, sex or national origin. All Bidders must comply with Title VI of the Civil Rights Act of 1964, the Davis-Bacon Act, the Anti Kickback Act and the Contract Work hours Act. The attention of Bidders is particularly called to the requirements as to conditions of employment to be observed and minimum wage rates to be paid under the Contract.
