The City of Burlington is experiencing significant development pressures within its urban boundary, which is resulting in conflicts between employment land uses and sensitive land uses. In addition, as a result of recent changes to the Planning Act, municipalities are required to make decisions on land use planning applications (i.e. zoning by-law amendments and site plan applications) in condensed timeframes, or risk the requirement for application fee refunds. The City is therefore seeking to retain consultants' assistance in the area of Land Use Compatibility to assist planning staff in reviewing and understanding land use compatibility matters for new development proposals and applications. Objectives are to protect employment areas from incompatible uses and encroachment by sensitive land uses; protect existing or planned major facilities from potential impacts from new sensitive land uses; and to prevent adverse effects to existing or planned sensitive land uses from new and/or expanding major facilities. The successfully prequalified consultant(s) would be invited to bid on future Scopes of Work to assist with research, analysis, preparation and authoring of peer reviews, reports and recommendations to Council on matters relating to Land Use Compatibility, inclusive of air quality (dust and odour), noise and vibration. Respondents will demonstrate their ability to perform the following potential deliverables: Review applications and supporting technical materials submitted in support of Official Plan amendments, Zoning By-law amendments, Subdivision applications, Community Planning Permit applications and Site Plan applications in accordance with relevant legislation and policy regarding land use compatibility which includes technical analysis of air quality, noise and vibration. This includes assessment of information and provision of recommendations to planning staff and standing committees of Council relating to land use compatibility; Assess all pertinent information in Official Plan amendments, Zoning By-law amendments, Subdivision applications and Site Plan applications relating to land use compatibility and prepares comments and recommendations for the consideration of the responsible planner and applicant. May provide recommendations to planning staff, applicants, Committee and Council and, carry out on-going consultation with applicants, and participate in public consultation as required. Review of proposals and technical studies submitted in preparation of Pre-Consultation Comments and/or technical review comments for pre-application processes. Includes scoping of Land Use Compatibility Study Terms of References with applicants. Assist in providing City planning staff review and analysis relating to land use compatibility in response to the circulation of Niagara Escarpment Commission Development Permit Applications within prescribed timelines as established by the Niagara Escarpment Commission (NEC); Appear at, present recommendations and respond to questions relating to land use compatibility matters at neighbourhood meetings, open houses, and meetings of standing committees of Council, as required; Provide advice to staff on City-led policy initiatives such as Official Plan Amendments, Official Plan Reviews, Provincial policy reviews, and special projects that have a land use compatibility component. Appear before the Ontario Land Tribunal (OLT) to give expert evidence on the City's behalf as it relates to land use compatibility and environmental matters related to Official Plan amendments, Zoning By-law amendments, Subdivision applications and Site Plan applications, as required; Defend their analysis, opinions and recommendations before the Ontario Land Tribunal.
