DESCRIPTION OF WORK: The project consists of building renovations and improvements as more particularly described in the bidding documents. RIGHT TO REJECT BIDS: The Town of Grafton reserves the right to reject any and all bids, the right to waive irregularities and informalities in bidding, the right to disregard all nonconforming, non-responsive, unbalanced or conditional bids, and the right to accept the bid which best serves the interests of the Town. CONTRACT SECURITY: No bid shall be received unless accompanied by a certified check or a bid bond equal to 5 percent of the bid payable to the Town as a guaranty that if the bid is accepted the bidder will execute and file the proper contract and performance bond within the time designated by the Town. In addition to the bid bond, the bidder to whom a contract is awarded will be required to execute the contract, and may be required to furnish a performance bond or other financial security acceptable by the Town, within ten (10) days of award of the contract. Bidders shall include in their bid an add alternate line item cost for the performance bond. If the selected bidder fails to execute the contract and file the performance bond, if required, within the ten (10) day period, the check or bid bond accompanying the bid shall be forfeited to the Town as liquidated damages. BID WITHDRAWAL: The Town reserves the right to postpone the award of the contract and no bids shall be withdrawn for a period of up to sixty (60) days after the date and time of the bid opening.
