Description of the Work The Work includes but is not limited to provision of Materials, Supplies (including solvents, lubricants, etc.), Equipment, Labor, and all incidental items and services necessary to repair and maintain the HVAC equipment anywhere on the GMX System at the locations shown on Exhibit A- 1-1, List of GMX HVAC Units and Locations, and in the timeframes specified on issued work orders. The Work shall be done in conformance with the manufacturer's recommendations and the latest version of the ASHRAE (American Society of Heating, Refrigerating, and Air Conditioning Engineers) and is intended to enhance the performance and reliability of the HVAC equipment servicing the GMX facilities ("the Work"). The Engineer's Estimate for this contract is Nine Hundred Forty-Six Thousand, Seven Hundred Thirteen Dollars and Zero Cents ($946,713.00) for the initial four (4) years term Contract Time The term of the Agreement shall be four (4) years with two (2) optional one (1) year renewals. At GMX's sole discretion and subject to the Contractor receiving no less than an "Excellent" rating in final Contract Performance Evaluation for the four (4) years of the Agreement, GMX may renew the term of the Agreement for an additional optional two (2) one (1) year renewals. If a Work Order is ongoing at the end of the term of the Agreement, GMX, at its sole discretion, may extend the term of the Work Order until the Work is completed. The Bidder, also referred to as the Contractor, shall carefully read and review the Solicitation Documents in their entirety to ensure an understanding of the requirements including the Prerequisite Criteria and the selection procedures. Bidders shall submit a sealed Bid Package in response to the Solicitation Documents. The Bid Package shall include associated costs for the completion of the Work and the requirements as detailed in the Solicitation Documents. By submitting a Bid Package, the Bidder acknowledges and agrees to the terms of the Contract Documents. GMX will only entertain changes to the Contract Documents that are addressed during the Procurement Process in accordance with the procedures outlined in the section entitled Communications, by the Deadline for Bidders to Submit Questions as specified in the section entitled Schedule of Events. Any changes accepted by GMX shall be addressed through an Addendum. After Bid Package submittal, GMX will not entertain any exceptions to the Contract Documents or accept conditional Bid Packages and reserves the right to deem such Bid Package non-responsive. The selected Contractor shall make available the necessary personnel, facilities, supplies, materials and resources to perform the Work. The Work shall commence upon receipt of a written Notice to Proceed from GMX. GMX reserves the right to make changes by increasing, decreasing and/or modifying the Work as detailed in the Contract Documents. Deadline to submit Questions 12/29/2023 5:00 p.m. Deadline for Responses to Questions 1/09/2024 T.B.D. NOTICE OF AWARD Once the GMX Board approves the final selection, a Notice of Award shall be posted on the GMX website showing the selection/award results. GMX reserves the right to cancel the award of the Contract at any time prior to the execution of the Contract by all parties without any liability against GMX, and with no compensation due to the Successful Bidder.
