A bid security in the amount of five percent (5%) of the bid amount must accompany each bid, in accordance with the Instructions to Bidders. The Scope of Work includes approximately 386' of sidewalk improvements including new asphalt driveway, concrete approaches, concrete sidewalk, concrete curb and gutter, concrete ADA ramps with detectable warning plates, storm sewers, utility adjustments, road signage, and other incidental items and work described in the Plans and Project Manual, or reasonably inferable therefrom, to construct the referenced project. The City of New Melle anticipates issuing notice to proceed in Spring of 2024. Please note that Missouris Prevailing Wage Law establishes a minimum wage rate for public works projects in Missouri valued over $75,000. If the project is over $75,000, the wage rates applicable to this project have been predetermined as required by law and are set forth in this specification. Effective January 1, 2009, and pursuant to RSMo 285.530 (1), No business entity or employer shall knowingly employ, hire for employment, or continue to employ an unauthorized alien to perform work within the state of Missouri. The successful bidder must submit a sworn affidavit and documentation affirming the business entitys enrollment and participation in the federal work authorization program and that all of its employees working for the contracted services are not illegal immigrants. Upon signing the contract, the successful contractor and any subcontractor performing the work shall provide a ten hour Occupational Safety and Health Administration (OSHA) construction safety program for their on-site employees. The City of New Melle hereby notifies all bidders that it will affirmatively ensure that in any contract entered into pursuant to this advertisement, disadvantaged business enterprises will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, or national origin in consideration for an award. The City of New Melle Intends to Award the Contract to the Most Responsive, Responsible Bidder Submitting the Lowest Bid. The Owner Reserves the Right to Reject Any and All Bids, and to Waive Any Irregularities in the Best Interest of the Owner. The successful bidder shall furnish a Performance Bond in an amount equal to one hundred percent (100%) of the Contract Sum as security for the faithful performance of the Contract, and also a Labor and Material Payment Bond in an amount not less than one hundred percent (100%) of the Contract Sum as security for the payment of all persons performing labor on the project under this Contract and furnishing materials in connection with this Contract. The Surety shall be a company licensed to do business in the State of Missouri and shall be acceptable to the Owner. The Performance Bond and the Labor and Material Payment Bond must be in separate instruments. The Owner shall have the right to reject any or all bids, to reject a bid not accompanied by the Bid Security or by other data required by the Bidding Documents, to reject a bid which is in any way incomplete or irregular, and to rebid the Work at a later date if all bids are rejected
