City of Midwest City 8 Water Line to Serve Baseball Complex 1. Midwest City Standard Bid Bond Or Surety Bid Bond Form or Cashier's Check in the Amount of Five 5 Percent Of the Total Bid Cashier s Checks Will Be Returned to the Unsuccessful Bidders Following the Acceptance of the Bid. The bid security is a pledge that the bidder will enter into a contract with the city on the terms stated in the bid and will furnish bonds covering the faithful performance of the contract and payment of all obligations. Should the bidder refuse to enter into such contract or fail to furnish the required bonds, insurance certificates and other required documents, the bid security shall be forfeited to the city as liquidated damages. The maintenance bond guarantees the maintenance in good condition of the workmanship and materials for a specified period after completion and acceptance of the project by the city. The maintenance period is specified in the contract documents. The bond for the maintenance period is in an amount equal to one hundred percent (100%) of the contract amount. The statutory bond guarantees that the contractor will make payment for all labor, materials and equipment used in the project. The Governing Body Reserves the Right To Review All Bids and Make the Award To the Lowest and Best Bidder. All Other Provisions of the Specifications Shall Also Apply. The Following Documents Comprise The Complete Bid Package and Must Be Submitted. Incomplete Bid Packages May Be Rejected. GENERAL DESCRIPTION OF WORK The work to be performed under the provisions of these contract documents consists of the following: furnishing all materials, equipment, tools and plant; the performance of all necessary labor; and the complete construction of facilities, including all work appurtenant thereto. 2. GENERAL CONDITIONS The General Conditions are general in scope and may refer to conditions not encountered on the work covered by this contract. Any provision of the General Conditions which pertains to a nonexistent condition and is not applicable to the work to be performed hereunder, or which conflicts with any provision of the Special Conditions, shall have no meaning in the contract and shall be disregarded. 3. SPECIFICATIONS The specifications that govern the materials and equipment to be furnished and the work to be performed under this contract are listed in the following paragraphs. No attempt has been made in the specifications to segregate work that is to be performed by any trade or subcontract. Any segregation between trades or crafts will be solely a matter for agreement between the Contractor and his employees and his subcontractors. All work performed under this contract shall be in full accordance with the laws and ordinances pertinent to such work. In case of any conflict wherein the methods or standards of installation or materials specified do not equal or exceed the requirements of the laws or ordinances, the laws or ordinances shall govern. All items required by the laws or ordinances but not specified or shown on the drawings shall be furnished without extra charge as shown or specified. These Special Provisions are supplemental to the City of Midwest City Water Main and Sanitary Sewer Line Installation Specifications and Details, current edition, and Standard Specifications for Highway Construction, Oklahoma Department of Transportation (ODOT) 2019 edition, which govern all areas/types of construction and shall be considered as a part of these specifications and contract. Where the stipulations of the Special Provisions and the Midwest City specifications or plans are in conflict, the interpretation of the plans and specifications shall be made by the City. The words "laws and ordinances" as used herein shall mean all local, state, or national codes, laws, ordinances, standards, rules or regulations of any nature which are in any way pertinent to, or regulatory over, the work covered by this contract.
