Vallecitos Water District is currently accepting electronic proposals for Asphalt List. The location of the work will be in Carlsbad, CA. Traffic control will be the responsibility of the contractor. Type of Award - Lump Sum Liquidated Damages - $500.00 Project Duration - 60 calendar days from Notice to Proceed Bid Bond 0.00% Payment Bond 100.00% Performance Bond 100.00% Pre-Bid Meeting - No Q&A Deadline - 12/05/2023 2:00 PM (PST). Bidders must be registered on the Vallecitos Water District's electronic bidding system in order to submit questions and receive addendum notifications. Deadline for questions shall be at 2:00 p.m. on Tuesday, December 5, 2023. Questions regarding the Project will be answered up to 5 working days before the bid opening. Because of the time necessary to notify bidders, no addenda will be issued within 5 working days of the date set for the opening of Bids. Bidders must be registered on the Vallecitos Water District's electronic bidding system in order to receive addendum notifications and to submit a bid. Go to electronic bidding system for bid results and awards. The Owner designates, Makrom Shatila, P.E., Michael Baker International, as the Engineer of Record under the Contract Documents. Contact Info: Meagan Funk 760-752-7148, mfunk@vwd.org There is no bid bond required for this project. Performance and payment bonds will be required if the contract price is $25,000 or higher. Please be sure to include bond costs with your bid if applicable. Bidders agree to obtain and maintain in full effect all required insurance with limits not less than the amounts indicated. Insurers must be authorized to do business and have an agent for service of process in California, have an A or better policyholder's rating and a financial rating of at least Class VIII in accordance with the most current rating by A.M. Best Company, a combined rating of at least A:VII. Bidders who fail to comply with the insurance requirements of this contract may have their bids rejected as non-responsive at the election of the District. The Contractor shall pay state prevailing wages in compliance with California Labor Code Section 1775 for each worker employed by Contractor, or any Subcontractor, sub-subcontractor of any tier, or supplier, to perform any part of the Work. This Project is subject to compliance monitoring and enforcement by the Department of Industrial Relations. In bidding on this Project, it shall be the Bidder's sole responsibility to evaluate and include the cost of complying with all labor compliance requirements under this contract and applicable law in its Bid. It is the Contractor's responsibility to maintain accurate payroll records in accordance with California Labor Code Section 1776. Pursuant to Labor Code sections 1725.5 and 1771.1, all contractors and subcontractors that wish to bid on, be listed in a bid proposal, or enter into a contract to perform public work must be registered with the Department of Industrial Relations. No Bid will be accepted, nor any contract entered into without proof of the contractor's and subcontractors' current registration with the Department of Industrial Relations to perform public work. If awarded a contract, the Bidder and its subcontractors, of any tier, shall maintain active registration with the Department of Industrial Relations for the duration of the Project. Notwithstanding the foregoing, the contractor registration requirements mandated by Labor Code Sections 1725.5 and 1771.1 shall not apply to work performed on a public works project that is exempt pursuant to the small project exemption specified in Labor Code Sections 1725.5 and 1771.1. If the total bid price exceeds $25,000, the successful bidder will be required to furnish a Faithful Performance Bond and a Labor and Material Payment Bond each in an amount equal to one hundred percent (100%) of the Contract Price. Each bond shall be in the District forms, shall be secured from a surety company that meets all State of California bonding requirements, as defined in California Code of Civil Procedure Section 995.120, and that is a California admitted surety insurer. Any cost associated with providing such bonds must be included in the bid price. The Vallecitos Water District, as a County Water District organized pursuant to Water Code Section 30000 et seq., has absolute discretion in awarding this contract and is not required to contract for construction of this Work with the lowest qualified responsible bidder; and, in the discretion of the District, a low bid may be determined by the amount of the bid for the Work with or without consideration of the prices bid on the additive or deductive items. Mobilization shall be limited to a maximum of 10% of the total bid price. Payment shall be made on a project after work has been completed. Progress payments for completed work are acceptable. No payments will be made for material only. Contractor shall and hereby does warrant that the Work and all equipment and materials shall be free from all defects due to faulty materials, equipment, or workmanship for a period of one year after the date of acceptance of the work. The Contractor agrees to act as a co-guarantor or co-warrantor with such manufacturer or supplier for the one year period provided in this Section or for such longer period designated in the guarantee or warranty provided by a manufacturer or supplier, whichever is longer, and shall furnish the Owner all appropriate guarantee or warranty certificates provided by manufacturers and suppliers upon completion of the Work. Nothing in the Warranty or in the Contract Documents shall be construed to limit the rights and remedies available to Owner at law or in equity, including, but not limited to, Code of Civil Procedure section 337.15.
