EL Camino Real Bridge Over Santa Margarita Creek Santa Margarita, CA This project will replace the existing bridge on El Camino Real about 2-1/2 miles north of Santa Margarita. The existing 80-ft, 5-span bridge will be replaced with a 100-ft single-span box-girder type structure. The new bridge will be 56 feet wide to accommodate bike lanes and center turn lanes for street intersections at both ends of the bridge. ENGINEER'S ESTIMATE: $7,395,031.80 Bids are required for the entire work described in the Contract Documents. The lowest bid and the DBE commitment percentage shall be based on the total bid price of the Base Bid and Additive Bid #1. Any changes, additions, or deletions to these Contract Documents will be in the form of written addenda issued by the County. Any addenda will be posted on electronically. Prospective bidders must check Electronic Portal for addenda or other relevant new information at up to 5:00 p.m. the day before the prescribed date/time for submittal of bids. The County is not responsible for the failure of any prospective bidder to receive such addenda. All addenda so issued shall become a part of this Bid. All bidders are required to acknowledge and confirm receipt of every addendum in their bid proposal. All bidder Requests for Information must be submitted no later than 3:00 p.m., 5 business days prior to the bid opening date. Requests submitted after said date may not be considered. All questions pertaining to the content of this invitation to Bid must be made in writing Electronically. Questions and responses will be posted on the Purchasing website and can be viewed by accessing the Invitation to Bid located Electronically . The identity of the entity submitting the question will not be posted. The County reserves the right to determine the appropriateness of comments / questions that will be posted Electronically. The bidder must have either a Class A license or a combination of Class C licenses that make up a majority of the work at the time the Contract is awarded (Public Contract Code section 3300). When the bidder holds a combination of Class C licenses, all work to be performed outside of the bidder's license specialties, except work that is incidental or supplemental to the licenses of the bidder, shall be performed by licensed Subcontractors in compliance with the Subletting and Subcontracting Fair Practices Act (Chapter 4 (commencing with section 4100) of Part 1 of Division 2 of the Public Contract Code) Pursuant to Labor Code section 1771.1: A Contractor or Subcontractor shall not be qualified to bid on, be listed in the Bid Proposal, subject to the requirements of Public Contract Code section 4104, or engage in the performance of this public works project, unless currently registered with the Department of Industrial Relations and qualified to perform work pursuant to Labor Code section 1725.5. It is not a violation of this section for an unregistered Contractor to submit a bid that is authorized by Business and Professions Code section 7029.1, Public Contract Code section 10164, or Public Contract Code section 20103.5, provided the Contractor is registered to perform public work pursuant to Labor Code section 1725.5 at the time the contract is awarded. This Project is subject to compliance monitoring and enforcement by the Department of Industrial Relations. Bids must be accompanied by cash, a certified or cashier's check, or a bidder's bond in favor of the County in an amount not less than ten percent (10%) of the submitted total Bid. Pursuant to Public Contract Code section 22300, the successful bidder may substitute certain securities for funds withheld by County to ensure performance under the Contract or, in the alternative, request the County to make payment of retention to an escrow agent. The successful bidder will be required to furnish the County with payment and performance bonds, with each issued by a California admitted surety insurer equal to 100% of the Contract Price. Pursuant to Labor Code section 1770 et seq., the Contractor and all Subcontractors shall pay not less than the prevailing rate of per diem wages as determined by the Director of the California Department of Industrial Relations and comply with all applicable Labor Code provisions, which include, but are not limited to the employment of apprentices, the hours of labor, and the debarment of Contractors and Subcontractors. The Director of the California Department of Industrial Relations determines the general prevailing wage rates. Copies are available electronically. Notice of Disadvantaged Business Enterprise (DBE) Requirements Bidders must take necessary and reasonable steps to ensure that DBEs have opportunity to participate in the Contract (49 CFR 26). It is the policy of the County of San Luis Obispo to practice nondiscrimination based on race, color, sex, or national origin in the award or performance of this contract. The County encourages participation by all firms qualifying under this solicitation regardless of business size or ownership. The County hereby notifies all bidders that it will affirmatively insure that in any agreement entered into pursuant to this advertisement, Disadvantaged Business Enterprises (DBEs) will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, sex, national origin, religion, age, or disability in consideration for an award. The contractor, subrecipient, or subcontractor shall take necessary and reasonable steps to ensure that DBEs have the opportunity to participate in this contract. The DBE goal is 20 percent. Notice of Davis-Bacon Requirements Federal funds are being used on this project, and therefore, the Davis-Bacon Act (2 CFR 200 Appendix II(D) and 29 CFR 5) applies. The Federal minimum wage rates for this project as predetermined by the United States Secretary of Labor are set forth in the Appendices. If there is a difference between the minimum wage rates predetermined by the Secretary of Labor and the prevailing wage rates determined to be applicable to this contract by the Director of the California Department of Industrial Relations for similar classifications of labor, the Contractor and Subcontractors shall pay not less than the higher wage rate. Title VI Solicitation Notice The County of San Luis Obispo, in accordance with the provisions of Title VI of the Civil Rights Act of 1964 (78 Stat. 252, 42 USC 2000d to 2000d-4) and related regulations, hereby notifies all bidders that it will affirmatively ensure that any contract entered into pursuant to this advertisement, disadvantaged business enterprises will be afforded full and fair opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, or national origin in consideration for an award. Notice of Requirement for Affirmative Action to Ensure Equal Employment Opportunity 1. The offeror's or bidder's attention is called to the "Equal Opportunity Clause" and the "Standard Federal Equal Employment Specifications" set forth herein. 2. The goals and timetables for minority and female participation, expressed in percentage terms for the Contractor's aggregate workforce in each trade on all construction work in the covered area, are as follows: A Goals for minority participation for each trade: 24.6% B. Goals for female participation in each trade: 6.9% These goals are applicable to all the Contractor's construction work (whether or not it is Federal or federally assisted) performed in the covered area. If the Contractor performs construction work in a geographical area located outside of the covered area, it shall apply the goals established for such geographical area where the work is actually performed. With regard to this second area, the Contractor also is subject to the goals for both its federally involved and nonfederally involved construction. The Contractor's compliance with the Executive Order and the regulations in 41 CFR 60-4 shall be based on its implementation of the Equal Opportunity Clause, specific affirmative action obligations required by the specifications set forth in 41 CFR 60-4.3(a), and its efforts to meet the goals. The hours of minority and female employment and training must be substantially uniform throughout the length of the contract, and in each trade, and the contractor shall make a good faith effort to employ minorities and women evenly on each of its projects. The transfer of minority or female employees or trainees from Contractor to Contractor or from project to project for the sole purpose of meeting the Contractor's goals shall be a violation of the contract, the Executive Order and the regulations in 41 CFR 60-4. Compliance with the goals will be measured against the total work hours performed. 3. The Contractor shall provide written notification to the Director of the Office of Federal Contract Compliance Programs within 10 working days of award of any construction subcontract in excess of $10,000 at any tier for construction work under the contract resulting from this solicitation. The notification shall list the name, address, and telephone number of the Subcontractor; employer identification number of the Subcontractor; estimated dollar amount of the Subcontract; estimated starting and completion dates of the Subcontract; and the geographical area in which the Subcontract is to be performed. 4. As used in this Notice, and in the contract resulting from this solicitation, the "covered area" is San Luis Obispo County, California. Notice of Federal Trainee Program As part of the Contractor's equal employment affirmative action program, the Contractor is to provide on-the-job training to develop full journeyman in types of trades or job classifications involved in the Contract. Notice of Requirements of Federal Fair Labor Standards Act All contracts and subcontracts that result from this Notice to Bidders incorporate by reference the provisions of 29 CFR 201, the Federal Fair Labor Standards Act (FLSA), with the same force and effect as if given in full text. The FLSA sets minimum wage, overtime pay, recordkeeping, and child labor standards for full and part-time workers. The Contractor has full responsibility to monitor compliance to the referenced statute or regulation. The Contractor must address any claims or disputes that arise from this requirement directly with the U.S. Department of Labor - Wage and Hour Division. Executive Order N-6-22 - Russia Sanctions On March 4, 2022, Governor Gavin Newsom issued Executive Order N-6-22 (the EO) regarding Economic Sanctions against Russia and Russian entities and individuals. "Economic Sanctions" refers to sanctions imposed by the U.S. government in response to Russia's actions in Ukraine, as well as any sanctions imposed under state law. Should the State or County determine Contractor is a target of Economic Sanctions or is conducting prohibited transactions with sanctioned individuals or entities, that shall be grounds for termination of this agreement. The County shall provide Contractor advance written notice of such termination, allowing Contractor at least 30 calendar days to provide a written response. Termination shall be at the sole discretion of the County. A pre-bid conference will not be held for this Contract. The County reserves the right to reject any or all bids, and to waive discrepancies, irregularities, informalities, or any other error in the bid or bidding, if to do so seems to best serve the public interest. The right of the County to waive errors applies even if the Contract Documents state that a discrepancy, irregularity, informality, or other error make a bid nonresponsive, so long as the error does not constitute a material error. The County reserves the right, in its sole discretion, to: judge the bidder's representations as stated in the Bid forms and any post-Bid information to determine whether or not bidder is qualified to perform the work; be the sole judge regarding the suitability of the products, services, or supplies offered; to not purchase all items or the full quantity of each item listed in the Bid Item List; reject any or all Bids; waive any deficiencies, irregularities, or informalities in any Bids or in the bidding process; modify, cancel, or withdraw the Notice to Bidders; issue a new Notice to Bidders; suspend or abandon the Project; seek the assistance of outside technical experts in Bid evaluation; require a bidder to provide a guarantee (or guarantees) of the Contract by a third party; and not issue a Notice to Proceed after execution of the Contract. In submitting a Bid in response to the Notice to Bidders, the bidder is specifically acknowledging the County holds these rights. The Notice to Bidders does not commit the County to enter into a Contract, to reject, in its sole discretion, all Bids, nor does it obligate the County pay for any costs incurred in preparation and submission of a Bid or in anticipation of a Contract. By submitting a Bid, the bidder disclaims any right to be paid for such costs. The work shall be diligently prosecuted to completion before the expiration of 130 working days (includes base bid and additive bid) from the date of receipt of the County's Notice to Proceed. The project goals include: 1) replace the deteriorating, hydraulically inadequate bridge; 2) accommodate a consistent 55 miles per hour (mph) posted speed corridor; 3) maintain traffic during construction; and 4) add a new center turn-lane for improved safety. The goal for female utilization is 6.9 percent. The goal for minority utilization is 24.6 percent.
