Each Bidder must complete and submit with their Bid the following: Non-collusive Bidding Certificate provided, in compliance with Section 103-d of the General Municipal Law of the State of New York. Iran Divestment Act Certification provided, in compliance with Section 103-g of the General Municipal Law of the State of New York, Iranian Energy Sector Divestment. Statement on Sexual Harassment Prevention provided, in compliance with Section 201-g of New York State Labor Law, regarding the implementation of a written policy addressing sexual harassment prevention in the workplace. The Bidder to whom the OWNER proposes to award the Contract will be required to furnish performance and payment bonds and the necessary insurance certificates as prescribed in the General Conditions upon the execution of the Agreement. The attention of Bidders is particularly called to the requirements as to the conditions of employment to be observed and the minimum wage rates to be paid under the contracts. Bidders are also required to comply with the anti-discrimination provisions of Sections 290-301 of the Executive Law of the State of New York. Each proposal from a Contractor shall be accompanied by a bid bond or certified check on a solvent bank of the STATE OF NEW YORK, in the amount of five percent (5%) of the total bid. Such check shall be made payable to VILLAGE OF PATCHOGUE, PATCHOGUE, NEW YORK, and the amount thereof shall be the measure of liquidated damages which the Village may sustain by failure, neglect or refusal of the bidder to execute and deliver the contract, should the contract be awarded to it. The checks of all unsuccessful bidders will be returned upon the rejection of bids and the awarding of the contract; also, the check of the successful bidder will be returned upon the execution of the contract and the furnishing of the required bon The successful bidder shall be required to furnish at the execution of the contract an executed bond of a surety company authorized to do business in the State of New York and approved by the Village Board, in an amount equal to 100% of the total amount of the contract, guaranteeing to the Board the faithful performance of the contract and payment of all claims for materials, labor and wages in connection therewith. Prior to the release of the Performance Bond, the Contractor shall deliver to the Village a Maintenance Bond equal to 100% of the total contract price, including all extras which shall remain in effect for a period of one (1) year from the date of the Engineers approval of the final payment request as a Guarantee Bond. The Village reserves the right to reject any or all bids, to waive any informality in any bid, and to accept that bid which it deems most favorable to the interests of the Village.
