Owner reserves the right to reject any and all Bids. Award, if made, shall be to the lowest responsible Bidder whose Bid is responsive to the invitation and is most advantageous to the Owner, in its sole and exclusive discretion, price and other factors considered. The Owner may reject a Bid as nonresponsive if the prices bid are materially unbalanced between the line items or subline items. A Bid is materially unbalanced when it is based on prices significantly less than the cost for some work and prices which are significantly overstated in relation to cost for other work, and if there is a reasonable doubt that the bid will result in the lowest overall cost to the Owner even though it may be the low evaluated bid, or if it is so unbalanced as to be tantamount to allowing advance payment. The Owner also reserved the right to waive all information not involving price, time or changes in the Goods and Special Services, and to negotiate contract terms with Successful Bidder. Bid security shall be furnished in accordance with the Instructions to Bidders. The Project consists of constructing approximately 56 miles of 3-inch through 8-inch diameter gasketed joint polyvinyl chloride potable water pipelines and appurtenances within existing service areas of the Tripp County Water User District in south central South Dakota. Bidders on this work will be required to comply with the Presidents Executive Order Nos. 11246 as amended, 11458, 11518, and 11625 as amended. The requirements for bidders and contractors under these orders are explained in the specifications. Bidders on this work are advised that the funding and/or regulatory agency for this project is the State of South Dakota. The low responsive bidder will be required to certify compliance with the American Iron and Steel provision of the Consolidated Appropriations Act of 2014. This certification form may be found on page AIS-21 of the State Revolving Fund (SRF) General Conditions and must be included in the bid proposal. The low responsive bidder must fulfill the requirements of the Davis-Bacon and Related Acts Labor Standards for federally assisted construction contracts. These standards are located in the SRF General Conditions. Please be advised that waivers or exemptions from the American Iron and Steel provision that cite International Trade Agreements DO NOT comply with the Consolidated Appropriations Act of 2014 as it applies to the SRF programs. Claims from suppliers that the American Iron and Steel provisions do not apply to certain products based on the International Trade Agreement exemptions of the Consolidated Appropriations Act of 2014 will not be accepted. Tripp County Water User District, the bidder certifies and agrees that the bidder, in preparing its response or offer or in considering proposals submitted from qualified, potential vendors, suppliers, and subcontractors, or in the solicitation, selection, or commercial treatment of any vendor, supplier, or subcontractor, is not an entity, regardless of its principal place of business, that is ultimately owned or controlled, directly or indirectly, by a Prohibited Entity from China, Cuba, Iran, North Korea, Russia, or Venezuela (as that term is defined in SDCL 5-18A-1(19A)). The bidder understands and agrees that, if this certification is false, such false certification will constitute grounds for Tripp County Water User District to reject the bid by the bidder on this project and terminate any contract awarded based on the bid. This certification may be found in Paragraph 24.10 of the Instructions to Bidders made available as part of this solicitation. The low responsive bidder will also be required to certify compliance with the above certification requirement at the time of contract execution. The low responsive bidder will thereafter be required to provide immediate written notice to Tripp County Water User District if, during the term of the contract, it no longer complies with the certification requirement and will be required to agree such noncompliance may be grounds for contract termination. A pre-Bid conference will not be held for this Contract. Goals for minority participation in each trade - 7.9% Goals for female participation in each trade - 6.9%
