The Town of Wethersfield, after review of all factors, including the terms and conditions, qualifications and price, reserves the right to accept or reject any and all bids, or any part thereof, or waive defects in the same, or accept any proposal or combination of proposals deemed to be in the best interest of the Owner. All bid documents must be completely filled out when submitted. Bids must be firm for a period of 90 days following the bid opening date. Bid withdrawal may be made only with the consent of the Town of Wethersfield A bid bond or certified check in the amount of 5% of bid is required to be submitted with the Bid. Bid Security will be returned to all except the successful bidder upon award. The successful bidder shall submit acceptable performance and labor and material bonds in accordance with these General Provisions, each in an amount equal to 100% of amount bid that is issued by a surety company authorized to do business in the State of Connecticut, indemnifying the Town of Wethersfield against any loss or expense in repairing, remedying or correcting the work performed by the licensee if the same is defective or not in accordance with the ordinance of the Town of Wethersfield. If necessary, these bonds may be renewed annually and will be released upon expiration of the contract. If no award has been made, bids may be withdrawn ninety (90 ) calendar days after bid opening. Please mark your envelope with the bid title and opening date to prevent a sealed bid from being opened prior to the opening date. Any bid not so marked and opened by the Town prior to date specified shall be rejected. The selected contractor shall be available on an as-needed, on-call basis for an anticipated period of approximately two (2) years or until available funds are expended. To the extent possible, any significant activities within the limits of wetlands, watercourses and FEMA flood plain areas will be conducted during the dry-weather conditions and when dry weather is forecasted, which is anticipated to primarily be during the winter and summer seasons. However, the Contractor must be available year-round and is expected to begin work in February 2024. Town staff and other current Town contractors may be retained to complete similar work as needed throughout the duration of the contract. The contract will expire on DECEMBER 31, 2025, unless amended by Change Orders. Any request from prospective bidders for interpretation of meaning of contract drawings, specifications or other contract documents must be made in writing to the Town of Wethersfield Finance Department via email at purchasing@wethersfieldct.gov. Requests must be received at least SEVEN (7) CALENDAR DAYS prior to date fixed for opening of Proposals to be given consideration. The Town will not hold a pre-bid meeting for this project. For every day work is completed, the Contractor shall contact the Engineering Department when they arrive onsite at the start of the day and when they leave the site at the end of the day at 860-721-2850 or engineering@wethersfieldct.gov to notify the Engineer the work hours for that day Interpretations will be made in the form of written Addenda to Contract Documents, which Addenda shall become a part of Contract. Not later than four (4) calendar days prior to date fixed for opening of Proposals, Addenda will be emailed to all persons who obtained Contract Documents posted on the Town and provide an email address to purchasing@wethersfieldct.gov. Failure of any bidder to receive any such Addenda shall not relieve bidder from any obligation under his Proposal as submitted All materials and work shall be subject to inspection by the Town Engineer or his designee (referred to as Engineer herein) at all times, and the Contractor will be held strictly to the true intent of drawings and specifications in regard to quality of materials, workmanship, and diligent execution of contract. Materials furnished under these specifications shall be approved by the Town prior to purchase, fabrication and delivery to the job site and are subject to such inspections. The Town shall be allowed access to all areas of the work site and shall be furnished such information and assistance by the Contractor as required to conduct complete and detailed inspections For this project, a sum of TWO HUNDRED AND FIFTY DOLLARS ($250.00) is agreed to by all Bidders as liquidated damages, and shall be paid by the Contractor to the Town for each and every calendar day in which a task assigned for this Contract is not completed after the period of time stipulated herein for such completion, and such costs shall be fixed with regard to this provision. The Contractor also agrees to pay these liquidated damages for each and every calendar day extending beyond fourteen (14) consecutive calendar days the site is vacated without work occurring and without authorization from the Town.
