Site work for a water / sewer project in Arcadia, Wisconsin. Completed plans call for site work for a dam / floodwall.

The scope of the project includes the following for Pond #1 of the existing Arcadia Aerated Lagoon WWTP: Sludge Removal and Disposal, Replace Aeration System, Replace Floating Baffle. The Contractor is the General Contractor, responsible for coordinating all phases of the project. A similar project will be performed on Pond No. 2 in a following year under a separate Contract. Sludge Removal and Disposal Remove Pond #1 sludge and dispose of the sludge via land application or landfill. Salvage the existing aeration system, stockpile owner-selected material on site and dispose of other materials. Remove and dispose of one (1) floating baffle and salvage the concrete anchors. Replace Aeration System Modify the existing aeration piping and furnish and install a new aeration system Replace Floating Baffle Furnish and install a new floating baffle to divide Pond #1 into Cell #1 and Cell #2. The Utility Commission, City of Arcadia, Wisconsin, reserves the right to reject any or all bids, to waive any informality in bidding and to accept the bid most advantageous to the City. No bid shall be withdrawn after the opening of bids without the consent of the City for a period of ninety (90) days after the scheduled time of closing bids. A certified check payable to the Utility Commission, City of Arcadia, or bid bond executed by the bidder and a licensed surety company in an amount equal to at least 5% of the maximum bid shall accompany each bid as a guarantee that if the bid is accepted, the bidder will execute and file the proposed contract and bonds within ten (10) days after the award of the contract. Performance Bond: (100% Contract Price) Payment Bond: (100% Contract Price) Minimum salaries and fringe benefits to be paid on the project shall be in accordance with the prevailing wage rate scale established by the Federal Department of Labor (DOL). Attention is called to the fact that not less than the minimum salaries and fringes set forth in the Contract Documents must be paid on this project and that the Contractor must ensure that employees and applications for employment are not discriminated against because of their race, color, religion, sex, national origin, or other protected class. Federal Labor standards program laws, including, but not limited to the Davis Bacon Act, the Copeland Anti-Kickback Act, and the Contract Work Hours and Safety Standards Act will apply to all projects. The American Iron and Steel (AIS) Requirement applies to this project. The Utility Commission, City of Arcadia, encourages Disadvantaged Business Enterprises (DBE's) to submit bid proposals. Any contract or contracts awarded under this notice may be funded in part by the Clean Water Fund Program (CWFP). Bidders are to fill out Bidder's Qualification forms furnished with the Bidding Documents. Forms are to be submitted separate from bids for review at bid opening. A pre-bid conference will not be conducted for this Project. Site Visit and Testing by Bidders A. Bidder is required to visit the Site and conduct a thorough visual examination of the Site and adjacent areas. During the visit the Bidder must not disturb any ongoing operations at the Site. B. Bidders visiting the Site are required to arrange their own transportation to the Site. C. All access to the Site other than during a regularly scheduled Site visit must be coordinated through the Owner or Engineer contact: Bidder must conduct the required Site visit during normal working hours. D. On request, and to the extent Owner has control over the Site, and schedule permitting, the Owner will provide Bidder general access to the Site to conduct such additional examinations, investigations, explorations, tests, and studies as Bidder deems necessary for preparing and submitting a successful Bid. Owner will not have any obligation to grant such access if doing so is not practical because of existing operations, security or safety concerns, or restraints on Owner's authority regarding the Site. Bidder is responsible for establishing access needed to reach specific selected test sites. E. Bidder must comply with all applicable Laws and Regulations regarding excavation and location of utilities, obtain all permits, and comply with all terms and conditions established by Owner or by property owners or other entities controlling the Site with respect to schedule, access, existing operations, security, liability insurance, and applicable safety programs. F. Bidder must fill all holes and clean up and restore the Site to its former condition upon completion of such explorations, investigations, tests, and studies. Interpretations and Addenda Owner on its own initiative may issue Addenda to clarify, correct, supplement, or change the Bidding Documents. Bidder shall submit all questions about the meaning or intent of the Bidding Documents to Engineer in writing. Contact information: Davy Engineering Co., 115 6th St. S., La Crosse, Wisconsin 54601. The contact information for the Project Engineer is shown on the title page of the specifications Interpretations or clarifications considered necessary by Engineer in response to such questions will be issued by Addenda delivered to all registered plan holders. Questions received less than seven days prior to the date for opening of Bids may not be answered. Only responses set forth in an Addendum will be binding. Oral and other interpretations or clarifications will be without legal effect. Responses to questions are not part of the Contract Documents unless set forth in an Addendum that expressly modifies or supplements the Contract Documents. Sludge Removal July 31, 2024 Aeration System and Floating Baffle September 1, 2024 Sludge Disposal December 10, 2024 Substantial Completion December 15, 2024 Ready for Final Payment December 31, 2024 Contractor and Owner recognize that time is of the essence as stated in Paragraph 4.01 above and that Owner will suffer financial and other losses if the Work is not completed and Milestones not achieved within the Contract Times, as duly modified. The parties also recognize the delays, expense, and difficulties involved in proving, in a legal or arbitration proceeding, the actual loss suffered by Owner if the Work is not completed on time. Accordingly, instead of requiring any such proof, Owner and Contractor agree that as liquidated damages for delay (but not as a penalty)
