No definite date for the rebid.** The Malaga County Water District is soliciting bids for construction of the Malaga Wastewater Treatment Plant Nitrogen Reduction Project. The Malaga County Water District hereby notifies all bidders that it will affirmatively insure that in any contract entered into pursuant to this advertisement, Disadvantaged Business Enterprises will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, religious creed, sex, or national origin in consideration for an award. In general, the Work consists of Demolish of DAF basin equipment, furnish and installation of two recculation pumps, valves, piping. F&I Anoxic Basin submersible mixers, modify blower room air piping, as shown on the plans. The additive alternate scope of work is F&I one recirculation pump, recirculation flow meter, guiderails in aeration basin for future mixers. F&I sludge digester connection pipe. F&I sludge flow meters, F&I influent EC meter, replace sludge digester fill valves as shown on the plans. Note that planholders must be registered with Provost & Pritchard Consulting Group as a planholder in order to receive notices and addenda. Bidding Documents may also be examined at Malaga County Water District and 3580 S. Frank Street, Fresno, California 93725. Minimum Wage Rates, as predetermined by the Secretary of Labor, are set forth in the Special Provisions. In accordance with the provisions of Section 1770 of the Labor Code, the Director of the Department of Industrial Relations of the State of California has determined the general prevailing rates of wages and employer payments for health and welfare, pension, vacation, travel time, and subsistence pay as provided for in Section 1773.8, apprenticeship or other training programs authorized by Section 3093, and similar purposes applicable to the work to be done. A copy of such prevailing wage rates are on file at the offices of the Malaga County Water District, and are incorporated herein by reference. The successful Bidder shall pay not less than the prevailing rate as determined by the Director of California Department of Industrial Relations. If there is a difference between the minimum wage rates determined by the Secretary of Labor and the prevailing wage rates determined by the Director of California Department of Industrial Relations of the State of California for similar classifications of labor, the Contractor and his subcontractors shall pay not less than the higher wage rate. NOTE: a. State wages on file with the Clerk of the Fresno County Board of Supervisors may be referred to. b. The Labor Code provides that State wage rates may be determined only by the Director of Industrial Relations; not by Local awarding bodies.(See LC Sec 1770- 1773.2) This project is subject to compliance monitoring and enforcement by the Department of Industrial Relations. No contractor or subcontractor may be listed on a bid proposal for a public works project unless registered with the Department of Industrial Relations pursuant to Labor Code section 1725.5 [with limited exceptions from this requirement for bid purposes only under Labor Code section 1771.1(a)]. Bidders shall furnish a Bid Security with their Bidders Proposal in the amount of 10% of the base bid amount. The work to be performed under this contract is on a project assisted under a program providing direct Federal financial assistance from the Department of Housing and Urban Development, Community Development Block Grant Program, and is subject to the requirements of Section 3 of the Housing and Urban Development Act of 1968, as amended, 12 USC 170lu. Section 3 requires that to the greatest extent feasible opportunities for training and employment be given to low and very low income persons residing within the project area and that the contracts for work in connection with the project be awarded to eligible business concerns which are located in, or owned in substantial part by persons residing in the area of the project. Regulations for implementing the Section 3 clause are contained in 24 CFR 135, as amended, and as specified in the project specifications. All pages of the Preliminary (Anticipated) Statement of Workforce Needs, also contained in the project specifications, will be required to be completed and submitted prior to award. All pages of the Final (Completion) Statement of Workforce Needs form shall also be required to be completed and submitted upon completion of construction. OWNER reserves the right after opening Bids to reject any or all Bids, to waive any informality or non responsiveness in a Bid, or to make award to the lowest responsive, responsible Bidder and reject all other Bids, as it may best serve the interest of the OWNER. Contractors License Classification: In accordance with the provisions of California Public Contract Code, Section 3300, the Malaga County Water District has determined that CONTRACTOR shall possess a valid Class A Contractors License, and shall be registered with the California Department of Industrial Relations, at the time of contract bid award. A Contractors license is not required for bidding the project.
