PROJECT Construction of: 1. New fieldhouse and associated facilities. The undersigned further agrees that the Certified Check, Cashier's Check, or Proposal (Bid) Bond in the amount of five (5%) percent of his Proposal, payable to the Abbott ISD, accompanying this Proposal, is left in escrow with the Architect, that it's amount is the measure of liquidated damages the Owner will sustain by the failure of the undersigned to execute and deliver the above-named agreement, or in furnishing the 100% Payment and Performance Bonds within ten (10) days of written notification of the award of the contract to him, then the Certified Check, Cashier's Check, or Proposal Bond shall become the property of the Owner; but if this Proposal is not accepted within forty-five (45) days of the time set for the submission of proposals, or if the undersigned executes and delivers said contract and bonds, the check shall be returned to him on receipt thereof. The estimated construction budget for the Project is Two Million and No/100 dollars ($2,000,000.00). Abbott ISD expressly reserves the right to Reject or cancel any or all proposals.
