SEALED BIDS for the furnishing of the necessary materials, labor, and construction of improvements as indicated for the project known as: Glamorgan Street & Mahoning Avenue Resurfacing Project The ODOT Construction and Material Specifications (CMS) and the City of Alliance rules and regulations shall apply to all work to be done under this contract. The DBE goal for this project is 7%. All Bidders shall submit a DBE Utilization Plan at the time of bid setting forth specific information demonstrating how the Bidder will achieve the DBE goal. By submitting a DBE Utilization Plan, the Bidder is affirming that they will be using the DBE firms identified in the Utilization Plan to meet the DBE contract goal. The DBE Utilization Plan shall be submitted with Formstack at the time of bid submission. Any bids received without electronic submission of the DBE Utilization Plan at or before bid time, will be deemed unresponsive. This file contains the current list of certified DBEs and is updated regularly. The DBE Utilization Plan must be filled out completely and submitted prior to bid opening. Additional information located on the ODOTs LPA Template #24 (PN 013) DBE Utilization Plan in the Supplemental General Specifications. The Contractor must be ODOT prequalified. The Bid shall be delivered by the time and to the place stipulated in the Notice Inviting Bids. It is the Bidders sole responsibility to see that its Bid is received in proper time and at the proper place. Each bid shall be accompanied by a certified or cashiers check in the sum of ten percent (10%) of the total amount of bid along with a consent of surety for the total amount bid; or a bid guaranty bond in the amount of 100% of the bid. Bid check must be drawn on a solvent bank and made payable to the City of Alliance, Ohio. Certified or cashiers check or bid bond shall be held as a guarantee that in the event the bid is accepted and a Contract awarded to the bidder, the Contract will be duly executed and its performance properly secured. Should the successful bidder fail or refuse to execute the Contract, within ten (10) days after receipt of notification of award, said check and the amount represented thereby, will be forfeited to the City as liquidated damages. The surety on any bond shall be liable to the City in an amount not to exceed ten percent (10%) of the bid. All bid guarantees shall be conditioned that if the bid is accepted within sixty (60) days of the bid opening, a proper Contract shall be executed. After the receipt of bids, the lowest and best bidder will be determined. The bond or check of all except the lowest three (3) bidders will be returned as soon as practicable. The remaining deposits will be returned as soon as a contract is executed and secured. In case the lowest and best bidder shall fail to execute and secure a Contract within ten (10) days, the award may be vacated and deposit forfeited as liquidated damages, and the Contract awarded to the next lowest responsible bidder who shall thereupon execute the contract and furnish the required bond or security for the performance of the Contract within ten (10) days or forfeit his/her deposit as liquidated damages. The successful bidder will be required to furnish a bond for the faithful performance of the Contract in a sum not less than one hundred percent (100%) of the total price bid for the completed work, said bond to be that of an approved surety company, to the satisfaction of the City Law Director. Agents of bonding companies which write bonds for the performance of the Contract shall furnish power of attorney, bearing the seal of the company, evidencing such agents authority to execute the particular type of bond to be furnished, and evidencing also the right of the surety company to do business in the State of Ohio. The copy of this proof shall be attached to each copy of the Contract. The City of Alliance will award a Contract or reject Bids within 10 days after Bid opening. The City will mail or e-mail a letter to the address on the Bid notifying the successful Bidder of Bid acceptance and Contract award. The City will award to the lowest competent and responsible bidder. The City will not award a Contract until it completes an investigation of the apparent low Bidder. The City will not award a Contract for an amount greater than 10 percent more than the Engineers estimate. The Engineers Estimate for the construction cost of this project, for all parts combined, is $908,000.00. The Bidder may request to withdraw their bid by means of a written request stating the reason for the withdrawal, signed by the Bidder or its properly authorized representative. Such written request must be delivered to the place stipulated in the Notice Inviting Bids for receipt of Bids prior to the scheduled closing time for receipt of Bids. The City is not obligated to grant the withdrawal of a bid and the Contractor may be liable for the cost difference between their bid and the next lowest bid. Award of the contract, if awarded, will be made to the lowest and best Bidder whose Bid complies with the requirements of the Contract Documents. Unless otherwise specified, any such award will be made within the period stated in the Notice Inviting Bids that the bids are to remain open. The bid will be awarded based on the combination of the base bid and the additive alternate bid items selected to be performed, which the City deems will best serve the City and is within the project budget as established in Ordinance No. 030-22. Unless otherwise indicated, a single award will be made for all the Bid items in an individual Bid Schedule. The City of Alliance reserves the right to reject any and/or all, or part of any and/or all proposals. The contractor and any subcontractor working at the site shall carry public liability and property damage insurance and owners protective insurance in the minimum amounts as established by the ODOT C&MS 107.12. Replace The State of Ohio, Department of Transportation with The City of Alliance as additional insureds. A certificate shall be provided evidencing the availability of the benefits of the workers compensation program for persons employed by the contractor. The contractor shall obtain and maintain worker's compensation coverage as required by law. The wages to be paid for work done under this Contract shall not be less that those stipulated in the Davis Bacon wage rate determination. The contractor shall provide the City with certified copies of all payroll reports to ensure that prevailing wage rates are being paid. The City may withhold payment of the Contractors invoices, without penalty, until payroll reports are received. No work shall be started and left unfinished for more than ten (10) working days, not including weather days. This includes the time between milling and asphalt or concrete placement. More time will be allowed for mitigating circumstances and weather days as long as work is progressing without delay. Date set for completion of the contract is August 30, 2024.
