It is the intent of the Township of Toms River to enter into a contract with the lowest responsive and responsible bidder(s) in compliance with these specifications. Sealed bids for the supply of grass seed, fertilizer, herbicides, fungicides, insecticides, infield mix, top dressing & bunker sand as required by the township of toms river, will be received by the purchasing agent of the township. Bidders are required to comply with the requirements of N.J.S.A. 10:5-31 et seq. and P.L. 1975 C. 127 (N.J.A.C. 17:27-1 et seq.) regarding equal employment opportunities and with the requirements of P.L. 1977 C.33 regarding corporate and/or partnership ownership. The right to reject any and all bids is reserved in accordance with applicable law. All bids shall be submitted electronically through the Township's electronic procurement portal by the date and time stipulated in the Notice to Bidders. Bids submitted prior to the date and time of opening may be withdrawn, modified or resubmitted, upon written application to the Division of Purchasing. Once bids are opened, they shall remain firm for a period of sixty (60) days. Bidders are cautioned when receiving bids through a third-party, as they may not be complete. All seeds, blends, and mixtures shall be interagency certified. All seed shall be at least 98% pure with 90% germination and free of POA ANNUA and NOXIOUS WEEDS. The Township will assume no responsibility for portabins while being utilized on Township property. It is strongly suggested that prospective bidders inspect the areas to be bulk spread to familiarize themselves with the site conditions. The Township will assume no responsibility for the contractor or their equipment when bulk spreading on Township property. Only manufactured and farm products of the United States, wherever available to be used in this work.
