If the total contract price exceeds $25,000.00, the Contractor shall execute in accordance with the provisions of Chapter 2253, Texas Government Code, a Payment Bond in the amount equal to the total contract amount, solely for the protection of those supplying labor, materials and/or equipment in the prosecution of the subject contract. If the total contract price exceeds $100,000, the Contractor shall execute in accordance with the provisions of said Chapter 2253, Texas Government Code, a Performance Bond in the amount of the total contract price conditioned upon the faithful performance of the contract, solely for the protection of the Owner. Final Completion: If Final Completion has not been achieved by on or before the Scheduled Final Completion Date, then Subcontractor shall pay to Contractor the following liquidated damages: $2,290 per day for each day until Final Completion is achieved is achieved.
