AB Tech reserves the right to reject any or all proposals and to waive any informalities. AB Tech reserves the right to award a contract to the lowest, responsive, responsible bidder. The OWNER may make such investigations as he deems necessary to determine the ability of the BIDDER to perform the WORK, and the BIDDER shall furnish to the OWNER all such information and data for this purpose as the OWNER may request. THE PROJECT GENERALLY CONSISTS OF Mobilization, removal of and disposal of hazardous materials, demolition, erosion control measures, and rough grading. The OWNER reserves the right to reject any PROPOSAL if the evidence submitted by, or investigation of, such BIDDER fails to satisfy the OWNER that such BIDDER is properly qualified to carry out the obligations of the Agreement and to complete the WORK contemplated therein. A conditional or qualified PROPOSAL will not be accepted. All applicable laws, ordinances, and the rules and regulations of all authorities having jurisdiction over construction of the project shall apply to the contract throughout. Each BIDDER is responsible for inspecting the site and for reading and being thoroughly familiar with the CONTRACT DOCUMENTS. Bidders and other interested parties should note that prequalification of equipment manufacturers by the Engineer prior to the bid opening may be required for this project. Equipment prequalification requirements, if any, are described in the Contract Documents. A certified check or cashiers check payable to AB Tech or a satisfactory Bid Bond executed by a corporate surety licensed under the laws of North Carolina to execute such bonds in the amount equal to five percent of the total of the proposal shall be submitted with each proposal. The successful bidder shall be required to furnish separate, 100 percent Performance and Payment Bonds in compliance with North Carolina General Statutes Section 143-129 and of Article 3 of Chapter 44A. The Performance Bond shall be in full force and effect for one (1) year after the date of final acceptance of the project by the Owner. The proposal deposit shall be retained by AB Tech if the successful bidder fails to execute the contract or fails to provide the required bonds, as stated above, within ten (10) days after award of the contract.
The failure or omission of any BIDDER to do any of the foregoing shall in no way relieve any BIDDER from any obligation in respect to his PROPOSAL. Each bidder must be appropriately licensed as a Contractor in the State of North Carolina as provided in General Statutes Chapter 87. Each bidder must have a North Carolina Contractor's License. Each bidder shall make positive efforts to use small and minority owned business enterprises on this project. Attention is called to the fact that the Contractor must ensure that employees and applicants for employment are not discriminated against because of their race, color, religion, sex or national origin.
