Denton ISD is seeking vendors who can provide paint supplies, equipment, & services to include mural artists to respond to this proposal, even if you are a sole source provider. This proposal will be awarded to multiple vendors. Awards resulting from this solicitation will designate the vendors as "approved vendors" to provide paint supplies, equipment, and services on an as needed basis. Denton ISD currently has 6 High Schools, 8 Middle Schools, 26 Elementary Schools, 2 Early Childhood Centers, 4 "Specialty" campuses and multiple Administrative Buildings and locations. Awarded vendor(s) may need to accommodate all locations on an "AS NEEDED" basis. This solicitation replaces RFP #1912-17, which will expire on January 31, 2024. Deadline for Questions: 1/17/24. Questions regarding the meaning or interpretation of this proposal shall be requested electronically. If needed, an addendum will be issued after January 17, 2024 in response to questions submitted prior to this cut-off date. Board of Trustees Approval: 2/13/24 Denton ISD reserves the right to revise and amend the specifications prior to the date set for the opening. Respondents are requested to clarify any ambiguity, conflict, discrepancy, omission or other error(s) in the proposal in writing and request modification or clarification as desired. Revisions or amendments to the proposal, if any, will be made by issuing an addendum. Every effort will be made to send addenda issued to the parties known to have been furnished a complete copy of the proposal. No oral interpretations will be made to offerors as to the meaning of proposal documents. Requests for such interpretations shall be made in writing. Failure on the part of the firm to do so shall not relieve them of the obligation to execute such work in accordance with a later interpretation by Denton ISD. All interpretations made to the offerors shall be made in the form of addenda to the proposal documents and posted to the website. Offerors are strongly urged to make arrangements to visit and inspect the site(s) prior to proposing if the configuration, structure, condition, etc., of the site will influence the proposal for contract performance. Denton ISD reserves the right to: a) Cancel this solicitation (No Response Required) in whole or in part, at the sole discretion of DISD b) accept, reject, or negotiate modifications in any terms of the Vendor's proposal or any parts thereof. c) Conduct oral interviews/discussions or presentations necessary to select the best value Vendor and/or to obtain competitive pricing. d) Reject and/or disqualify any or all proposals received, to award contracts for individual products or services as may appear advantageous, and to negotiate separately in any manner necessary to serve the best interest of DISD e) Waive any formalities, technicalities, or other defects if deemed in the best interest of DISD; Request clarification and/or correction of Vendor(s) for the purpose of eliminating minor errors, clerical errors, and/or non-substantive irregularities. f) Be the sole judge of quality and equality. g) Award one or more contracts, in part or in whole, to a single or to multiple Vendors, in DISD sole discretion. h) Make all decisions regarding this solicitation, including, without limitation, the right to decide whether a proposal substantially complies with the requirements of this request. It is the intent of the district to award all or none, but reserve the right to award section by section, or item by item, multiple awardees, whichever is in the best interest of the district. Denton Independent School District reserves the right to accept or reject any or all proposals or bid; waive minor technicalities and to accept the bid or bids that are determined to be the best value by the District and in the sole determination of the district. The District's specifications, terms and conditions are contract terms that are legally binding upon awarding the contract to the vendor, and establish quality/performance requirements of the vendor and the personal property being purchased for the full term length of such contracts. If bidder is awarded a contract, the District shall have the right to terminate for default all or any part of the contract if bidder breaches any of the terms herein or if the bidder becomes insolvent or files any petition in bankruptcy. Such right of termination is in addition to and not in lieu of any other remedies which the District may have under contract or in law or equity, specifically including, but not limited to, the right to collect for damages or demand specific performance. The District has the right to terminate this contract for convenience, without penalty, if the District fails to appropriate funds or provide for an annual renewal of a contract, following delivery of notice to the bidder specifying the extent to which performance here-under is terminated and the date upon which such termination becomes effective.
