The Port of Oakland (the "Port"), through its Purchasing Department, is hereby soliciting competitive proposals for the above-mentioned project. The successful Respondent will be required to furnish all labor, material, equipment, supplies, applicable taxes, insurance, bonding, and licenses to complete this project Project Overview: The Port of Oakland (Port) is soliciting proposals from qualified consultants to provide "as-needed" environmental planning consulting services including federally-funded projects. Qualified consultants will assist in compliance with the California Environmental Quality Act (CEQA) and the National Environmental Protection Act (NEPA), obtaining land use permits from regulatory agencies, biological survey and monitoring work, and conducting and writing environmental planning and technical studies related but not limited to topics such as alternative fuels, sea level rise, air quality, waste & water management, and site feasibility. The Port expects that Responders will be comprised of a Prime Consultant as the Proposer and a number of supporting Subconsultants (hereafter referred to as "consultant team", "Responder", "Proposer", "Consultant"). The Port intends to award up to ten (10) separate contracts, including up to two (2) contract for designated qualified Small Business Enterprise (SBE) or Very Small Business Enterprise (VSBE). The Port anticipates executing each contract for a term of up to three (3) years and an estimated contract value of $500,000, pending approval by the Board of Port Commissioners (Board). The Port will also have the option to issue two (2) one-year extensions not to exceed a total period of 5 years (at the costs quoted in this proposal). However, the actual volume of work could vary; execution of an Agreement will not constitute any guarantee of business or level of compensation. Firms with active contracts solicited under the Port's RFP for As-Needed Environmental Planning Consulting Services (21-22/29) are eligible to participate in this RFP. If any such firm is selected under this RFP, the Port will execute new contracts and will manage existing contracts in the manner that best serves the interests of the Port. Note that the number of contracts, the contract value, the timing of contract execution, and the duration of contracts are subject to change until adopted by the Board. Contracts will be managed by the Port's Environmental Programs and Planning (EPP) staff member. Portions of this work may be funded by Federal and state grant funding. The successful Respondent will be required to comply with any additional Federal or State funding requirements. Scope of Services: In order for EPP to provide timely project turn-around to its internal and external clients, including regulatory agencies, and to supplement the Port's expertise and existing resources, EPP staff rely on environmental consulting firms for environmental planning services. The success of EPP is driven by technical expertise, good project management, and understanding and responsiveness to client needs. A. Environmental Planning Services Implementation An EPP staff member will be assigned as Contract Manager for each Consultant contract. An EPP staff member will also serve as Project Manager and provide project oversight and guidance for specific projects. The EPP project manager for a project will not necessarily be the EPP contract manager. Each project will be initiated by the EPP Project Manager and through collaboration with the Consultant, a detailed scope of work will be prepared that includes staffing, budget, deliverables, and schedule. These components comprise a Technical Service Order (TSO), which provides written authorization and which, when signed by both the Port and the Consultant, is considered executed, serves as the Notice to Proceed, and binds the work to the terms of the TSO and Consultant contract. Neither the Consultant nor a subconsultant or subcontractor shall perform services or incur billable expenses prior to a TSO being executed. At times and separate from the as-needed environmental planning consulting services, the Port may issue a formal RFP for environmental planning services that are project-specific and based on an anticipated scale or duration of a planned project. At those times, consultants on the Port's as-needed environmental planning consulting services are welcome to submit a proposal, but such RFPs will not be limited to consultants on the Port's as-needed environmental planning consulting services list. B. Scope of Work/Services Environmental planning tasks under this RFP scope of services encompass a range of environmental topics required under CEQA and NEPA and other environmental planning tasks. Consultants shall be capable of producing quality, legally defensible environmental documents and deliverables that are wellwritten and easily understood by the general public, consistent with both internal and other relevant documents. The nature of the type of environmental planning services required encompass day-to-day services, longer-term planning, and implementation. Consultants must also have in-house desktop publishing capabilities for preparation of high-quality graphics, as the Port will not provide any graphics support. In addition, the selected consultant must have the ability to produce documents in hard copy and electronically in a format suitable for digital and print use. Consultants shall also have familiarity with producing ADA-compliant documents. It is recommended that consultants have the ability to share files and documents with the Port on a secure cloud-based system, such as, but not limited to, Microsoft SharePoint. The consultant team chosen to provide the Port with environmental planning services should have the capability to perform work including, but not necessarily limited to, the below types of services. The Port does not require any one entity to specialize in all areas identified below; the Port may select a mix of consultants to provide the necessary set of skills. Consultants may wish to assemble a team or partnership to provide a broader scope of services to the Port. In this case, a single primary consultant must be identified; other associated firms must be identified as sub-consultants. A consultant team should not be discouraged to apply if experiences with types of services listed below do not have a direct application to Port, aviation, or maritime operations. In addition to the below, the consultant team chosen shall demonstrate to the Port that they can perform services using good project management in order to deliver projects on time and within budget. The non-exhaustive list of environmental planning services requested for this RFP includes: 1. Environmental Assessments and Review a) Prepare environmental review documents and associated public notices for Port development projects as required under NEPA and CEQA, included but not limited to: o Project Descriptions o Alternatives Analysis o Existing Conditions o Impact Overview o Analytical Methodology Assessment o Biological Assessments o Section 106 Consultations o AB52 Consultation o Environmental Justice o Mitigation Monitoring and Reporting Programs o Mitigation Measure Feasibility Studies o Implementation and Compliance Reporting o Initial Studies o Negative Declarations o Mitigated Negative Declarations o Environmental Impact Reports o Application Summary Reports o Department of Transportation Section 4(f) Evaluation b) Prepare Categorical Exclusions, Environmental Assessments (EA) and Environmental Impact Statements (EIS) jointly with federal agency partners, such as the United States Army Corps of Engineers, Federal Aviation Administration (FAA), U.S. Department of Transportation Maritime Administration (MARAD), or the United States Department of Transportation, etc. in accordance with NEPA. c) Prepare, facilitate, organize, and attend/participate in public outreach and coordination, and public scope meetings and hearings. d) Prepare materials and presentations for meetings. 2. Technical Analysis a) Prepare technical analysis under requirements of CEQA, NEPA, and the California Coastal Act to a wide range of environmental issues including: o Aesthetic, Visual, and Light Emissions o Air Quality and Greenhouse Gas Emissions o Air Toxics Health Risk o Alternative Fuel o Biological Monitoring and Risk (Endangered Species Section 7) o California Coastal Act, Coastal Land Use, and Recreational Issues o Cultural Resources and Tribal Cultural Resources o Economics, Population, and Housing o Environmental Justice o Geology, Soils, and Seismicity o Energy o Hazards and Hazardous Materials o Hydrology, Stormwater, Flooding, Aquifer, and Water Quality o Human Health Risk, o Land Use, Plans, and Policies o Noise and Vibration o Public Safety and Health o Public Utilities Services o Sea Level Rise and Climate Resilience o Transportation and Traffic (VMT, LOS) o Wetlands/Marine Habitat Restoration and Design 3. Tracking and Analysis of CEQA/NEPA Legislation, Regulation, Case Law, and Guidance Updates a) Review existing, proposed, and potential federal, state, and local-related laws, regulations, and guidance for applicability to the Port and Port projects. b) Prepare comments, summaries, findings, and recommendations. c) Prepare and attend/participate in public meetings, hearings, and workshops. 4. Mitigation Measures Development, Monitoring, and Annual Tracking 5. Grant Applications 6. Environmental Review and Permit Support a) Permit applications and support to the U.S. Army Corps of Engineers, SF Bay Regional Water Quality Control Board, SF Bay Conservation and Development Commission, Bay Area Air Quality Management District and other agencies, with related negotiations, mitigation design, and compliance. 7. Legal Challenges and Litigations Support 8. Training Session, Workshops, and Presentations 9. Sustainability Management 10. Graphics, Design, and GIS Support a) Graphics may include infographics, charts, tables, maps, and others. b) Design may include branding of a project, document layouts in InDesign, web design, and marketing collaterals for both print and electronic transmittals. c) Work with the Port's GIS Administrator in providing GIS support utilizing Esri software suite. Consultants planning to provide GIS Support to the Port must meet the GIS Standard of Practice listed in Attachment 12. Tasks may include but are not limited to: o Develop, design, and maintain GIS data o Data management, data collection, data automation, spatial analysis, monitoring, mapping and visualization o Conducting quality assurance and integrity checks to ensure data is delivered to the Port's GIS standards of practice o Analyzing data management workflows and processes o Implementing maintenance processes or workflow improvements o Leading or assisting field efforts utilizing GNSS receivers, ArcGIS Field Maps, ArcGIS Survey123, ArcGIS QuickCapture, etc. o Creation of commercial off-the-shelf (COTS) configurable apps within the Esri software suite (ArcGIS Dashboards, ArcGIS Experience Builder, ArcGIS Story Maps, ArcGIS Pro and suite of Esri mobile applications), web maps, figures, metadata, etc. o GIS data modeling o Other GIS tasks as needed 11. Project Management 12. No questions regarding the specifications will be responded to after the above date. All pertinent questions will be responded to and answered in writing no later than the Response Date listed below. Response Date February 2, 2024 All pertinent questions will be responded to via addendum emailed to all prospective proposers and placed electronically. Proposers who did not receive a copy of the addendum should obtain it from electronically. All addenda must be acknowledged on the RFP Acknowledgement and Signature form. Once the RFP is issued, and until a recommendation for award is made to the Board of Port Commissioners at a public Board of Port Commissioners meeting (or in cases where a recommendation for award does not require a public Board meeting, when Proposers are notified by Port staff of the recommendation for award), each Proposer and its representatives, agents, and affiliates, shall not contact members of the Evaluation Committee, Port staff or the Board of Port Commissioners to discuss or ask questions about the contents of this RFP or the selection process. All questions shall be submitted in writing as described in this RFP. Any inappropriate contact by a Proposer, its representatives, agents, and/or affiliates may result in the Proposers' proposal being disqualified. The Port reserves the right to reject any or all proposals, to waive any irregularities or informalities not affected by law, to evaluate the proposals submitted, and to award the contract according to the proposal which best serves the interests of the Port. The method of Contractor Selection has not been Determined at this time.
