Locate, purchase, deliver and install Imported Planting Soil and soil amendments. 2. Harvest and stockpile existing site soils suitable for Planting Soil. 3. Modify subgrade to loosen and observe to verify acceptable drainage. 4. Fine grade Planting Soil. 5. Install Compost and other specified amendments into Planting Soil. 6. Clean up and disposal of all excess and surplus material. Campus and accessibility improvements located along Munson's Genesee Street frontage in the City of Utica. Improvements include removals, earthwork, removal of existing concrete retaining walls, installation of cast in place concrete walls, concrete ADA ramp and railings, stone masonry, brick pavement, permeable brick pavement, site lighting, soil preparation, plant installation, lawn establishment and irrigation. This mutual waiver is applicable, without limitation, to all consequential damages due to either party's termination in accordance with Article 20. Nothing contained in this Section 21.11 shall be deemed to preclude an award of liquidated damages, when applicable, in accordance with the requirements of the Contract Documents. The Owner reserves the right to reject any bid if the evidence submitted by, or investigation of, such bidder fails to satisfy the Owner that such bidder is properly qualified to carry out the obligations of the contract and to complete the work contemplated therein.
