If the subcontractor fails to complete the work within the time specified in the contract and such failure is due to reasons which were not beyond the reasonable control of the subcontractor or if the subcontractor fails to complete the work within the time specified in the Subcontract and fails to make a written request for extension, then in any such event the subcontractor shall pay to Selzer-Ornst actual damages. Selzer-Ornst and/or MPS reserves the right to assess liquidated damages in the following amounts: 1. Subcontract amount below $25,000... $50 per calendar day 2. $25,001 to $50,000 $100 per calendar day 3. $50,001 to $250,000 $250 per calendar day 4. $250,001 to $500,000 $500 per calendar day 5. $500,001 to $1,000,000 .$1,000 per calendar day 6. $1,000,001 to $1,500,000 $1,500 per calendar day 7. $1,500,001 and above $2,000 per calendar day Project Close Out: Subcontractor shall provide email to Alicia Tremain - atremain@selzer- ornst.com for each site with the following requirements: Follow closeout requirements outlined in specifications. Email title should include MPS project number found on the drawings, MPS site name and "Closeout and Invoice" statement in the subject line. Statement that all systems are operating as intended. If any items are found to be incomplete during the close out inspection and MPS exercises their right to charge for re-inspection, these charges will be the sole responsibility of the subcontractor. The current rate is $90/hour, but this may change over time.
