Site work for a civil project in Wakonda, South Dakota. Completed plans call for site work for a water / sewer project.

The Project consists of a base bid including installation of the new booster station as well as accompanying piping and appurtenances, mechanical, electrical, and site work. Alternate A consists of constructing the 1.0 MG Ground Storage Reservoir. Alternate B consists of constructing the 0.75 MG Ground Storage Reservoir. All Work shall occur at the specific locations identified in the Contract Drawings. Bids shall be on a lump sum and unit price basis, with additive alternate bid items as indicated in the Bid Form. Question Deadline 02/08/2024 All questions about the meaning or intent of the Bidding Documents are to be submitted to Engineer in writing. Interpretations or clarifications considered necessary by Engineer in response to such questions will be issued by Addenda delivered to all parties recorded as having received the Bidding Documents. Questions received less than seven days prior to the date for opening of Bids may not be answered. Each bid must be accompanied by a certified check or bank draft payable to the order of Clay Rural Water System in an amount equal to five percent (5%) of the total bid. A bid bond is an amount of equal to ten percent (10%) of the total bid will be accepted in lieu of a certified check or bank draft. Surety for bid bond must be authorized to do business in the State of South Dakota. Pursuant to State Law, a copy of the bidder's sales and use tax license and a copy of the bidder's excise tax license is issued by the State of South Dakota must accompany the bid. In lieu of a copy of the license, the bidder shall submit appropriate evidence that the bidder and all affiliates have the appropriate licenses. All winning contractors and/or subcontractors must be registered in the System for Award Management (SAM) prior to beginning work on the project. Bidders are advised that a contract awarded for this project will be funded by the South Dakota Department of Agriculture and Natural Resources State Revolving Fund (SDDANR SRF). This project may be partially funded using American Rescue Plan Act (ARPA) funds. As a condition of the ARPA funding guidelines, the Contractor is shall meet the following minimum requirements: Based on the "Build America, Buy America" provisions of the Infrastructure Investment and Jobs Act (IIJA) and E.O. 14005 which provide that, as appropriate and to the extent consistent with law, a preference will be provided to Contractors for the purchase, acquisition, or use of goods, products, or materials produced in the United States (including but not limited to iron, aluminum, steel, cement, and other manufactured products.) The Contractor shall provide documentation of their efforts to meet the provisions of "Build America, Buy America" upon request. Davis Bacon Wage Rates will apply in its entirety. Contractors and/or subcontractors performing work will be required to comply with all requirements of the above-listed agency. Neither the United States nor any of its department's agencies or employees is or will be a party to this Invitation to Bid or any resulting contract. Bidders on this work will be required to comply with the President's Executive Order Nos. 11246 (Equal Employment) as amended, 11518 (Small Business Concerns), and 11625 (MBE) as amended. The requirements for bidders and contractors under these orders are explained in the specifications. Bidders on this work will be required to comply with Title 40 CFR 33 and Executive Order 12138 (WBE). The goal for Minority-Owned Business Enterprise (MBE) on this project is one percent (1.0%) and the goal for this Women-Owned Business Enterprise (WBE) on this project is four percent (4.0%). The goals and other requirements for bidders and contractors under this regulation which concerns utilization of disadvantaged/minority business enterprises are explained in the Contract Documents. Attention is called to the "Equal Opportunity Clause" and the "Standard Federal Equal Employment Opportunity Construction Contract Specifications". The requirements for bidders and Contractors under this order are explained in the Contract Documents. In addition to all of the above-listed Federal requirements for work on this project, compliance with the contract Work Hours and Safety Standards Act, Executive Order 11375, Copeland Act, The Clean Air Act, and Water Pollution Contract Act and subsequent amendments to all of the above will be required of contractors and/or subcontractors performing work on this project. The low responsive bidder will be required to certify to compliance with American Iron and Steel provision of the Consolidated Appropriations Act of 2014, as well as, shall assure compliance with the requirements of Public Law 115-232, Section 889, Prohibition on Certain Telecommunications and Video Surveillance Services or Equipment. Contractors must assure that telecommunications equipment produces by Huawei Technologies Company or ZTE Corporation (or any subsidiary or affiliate of such entities) and video surveillance and telecommunications equipment produced by Hytera Communications Corporation, Hangzhou Hikvision Digital Technology Company, or Dahua Technology Company (or any subsidiary or affiliate of such entities) WILL NOT be supplied for the project. Bids may be held by the Owner for a period of no more than thirty (30) days from the date of opening bids for the purpose of reviewing bids, investigating qualifications of the bidders, and completing financial arrangements prior to award of Work. Owner reserves that right to reject any and all bids. Section 746 of Title VII of the Consolidated Appropriations Act of 2017 (Division A Agriculture, Rural Development, Food and Drug Administration, and Related Agencies Appropriations Act, 2017) and subsequent statues mandating domestic preference applies an American Iron and Steel requirement to this project. All listed iron and steel products used in this project must be produced in the United States. The term "iron and steel products" means the following products are made primarily of iron or steel: lined or unlined pipes and fittings, manhole covers and other municipal castings, hydrants, tanks, flanges, pipe clamps and restraints, valves, structural steel, reinforced precast concrete, and construction materials. The deminimis and minor components waiver do not apply to this contract.
