Proposals must be accompanied by a certified check or bid bond, in an amount not less than ten (10) percent of the base bid, payable to City of Boaz. Bids must be submitted on forms identical to the proposal forms furnished by the Engineer in the project manual. No bids may be withdrawn for a period of sixty (60) days after the scheduled closing time for receipt of proposals. The owner reserves the right to waive in informalities and to reject any or all bids and make an award as appears to be in his best interest. All bidders must be licensed the State of Alabama Board of General Contractors, as required by Alabama Law, Chapter 8 of Title 34 of the Code of Alabama 1975 as amended by Act 96-640 effective May 1996. The bidders current license number must be displayed on the sealed envelope. Bid proposal form included in the project manual shall be delivered to Pinnacle Engineering ahead of the bid or submitted prior to 10:00 am on the day of bid. Proposals bearing the following information on the front of the bid envelope. Bids that exceed $50,000.00 shall be accompanied by a Bid Guarantee of not less than ten percent (10%) of the base bid, but in no event more than $10,000, which may be a bid bond on certified check made payable to the owner. Performance and material bonds are required when bids exceed $50,000.00. Bid bonds are to be issued by an acceptance bonding company licensed to do business in the state, with a power of attorney, to confess judgement thereon, with the understanding that it shall guarantee that the bidder shall not withdraw his bid for a period of sixty (60) days after the scheduled closing time for the receipt of bids; that if his bid is accepted, he will enter into a formal contract with the owner, and that in the event of a withdrawal of said bid within said period, or the failure to enter into said contract within the time specified, the bidder shall be liable to the owner for the full amount of the bid guarantee as liquidated damages and not as a forfeit or as a penalty.
